DV-2012 AOS - What is my next step?

Hey all,

I won DV-2012 with a 2012EU00003XXX number, so pretty low. I am in the USA under a new 3 year R-1 visa, so I am going to file for an AOS.

I have completed:
- Cover note
- Online NL & Barcode Sheet
- DSP-122 (and Addendum explaining education fulfillment regarding "College, no degree" as I dropped out after 2 years).
- 2 x photographs
- DS-230 (is this necessary?) and it's addendum

What do I do now? Do I simply send this to KCC?
Do I need DS-230.. or should I include it for safe-sake.
Then what? Must I send $$ to.. who. One payment or two? (I'm confused over this).
And then...?

Congrats to everyone who have been selected for DV2012. I have been trying to find/figure out what the right steps are for those who already are in the US with F-1 visa.

I called up the KCC today to get clarification on what the next step would be for those who are currently in the US with a f-1 visa and would apply for adjustemnt of status in the US.

The lady told me that; fill out DSP-122 and make sure you write USCIS or BCIS in question #4 and mail it along with 2 (two) passport photos and the barcode.
Writing a cover letter is up to you, it is not the deal breaker.
After KCC receives the DSP-122 and the photos, they will mail out payment information; when to make the payment and where to send it.
The KCC will also send the information about the next steps.

DO NOT SEND DS-230 IF YOU ARE DOING AOS
DO NOT SEND ANY PAYMENTS YET
 
So I *do not* send DS-230? What if I included it, noting to disregard it if it is not necessary? Has anyone (ie: in 2011) simply got an AOS with DSP-122 alone?

Trust me I called the KCC at least 5 times, because I wanted to make sure that I am sending the correct documents. I also emailed them and asked. All of the responses I got was" just send the dsp-122 along with 2 passport photos and the bar code, and if you are doing AOS in the US make sure you write BCIS or USCIS in the question #4 in DSP-122.

DS230 is required for those who are doing Consular Processing.

So I will just send DSP-122, photos and the barcode to KCC. Must I immediately send some kind of payment to the other place.. or do I simply wait at this stage?

So I send 1 form, 2 photos and a barcode.. and pay nothing.. until? Should I hear from them? Do you also know if AoS from R-1 visa is valid? I assume so?

As long as your status in the US is legit/legal you are fine. You can do AOS.

Just send with USPS certified so that you can get notification that your mail got delivered.

Once the KCC receive your DSP-122 barcode and two photos, with in 6-8 weeks they will notify you about the payment.

Also make sure to write BCIS or USCIS in #4 question in DSP-122.

Guys , it doesn't always work like that? Every case is different and every field office has its own processing time and datelines differe from case to case.

Guys , it doesn't always work like that? Every case is different and every field office has its own processing time and datelines differe from case to case.

As mentioned in the post " it is just a scnenario on how things will work". Timing, of course, may differ from case to case.
 
AOS on E2 Status

Hey guys! Long time reader, first time poster.

Not going to crash this thread, but just 3 quick questions...

1. I just won the 2012 lottery and am going to do the AOS. I am on an E2 visa and from my research I qualify for an AOS as my E2 doesn't expire until mid 2012. If I am incorrect in taking the AOS as a valid pathway on an E2, please offer advice
2. I am preparing my i-485 early and under "part 2' it is asking 'I am applying for an adjustment to permanent residence because:" As it doesn't state 'visa lottery' anywhere, I was assuming I need to tick 'A' and supply the letter I get back from KCC as 'evidence' true?
3. When I send off my DSP 122, 2x photos and barcode, I read above that i do not need to send any payments, however could I send payments in advance to speed up the process or is it just best to wait until I recieve the second letter back from KCC with instructions?

I want to congratulate everyone past and present who has been lucky enough to be granted a place in the greencard lottery. It must be slightly repetitive for some of you who have been through this with your own greencards, but your assistence for us newbies is very, very much appreciated. Thank you in advance :) -A.J
 
Regarding R-1 i think you should check if you are eligible. for example, J-1 holders can't do AOS if they haven't been outside of the US for 2 years prior applying. so either just call them and ask and check on line.

p.s. i was advised against sending advance payment. don't know why, but that's what i was told.

I haven't leave the country since then, it's been 3 years now. My J-1 visa says, "bearer is not subject to section 212(E) two year rule does not apply". Does it make me eligible?

FGARICI53, my case number is pretty low. It's in 1*** range. It should be current in October 2011. I see that yours was current in November, but your interview was scheduled in January.. What exactly "current number " means? I was hoping to have an interview in October already, however the interviews are not scheduled within the same month the number becomes current, correct? What month do you think I will have an interview?

No, if you are an F1 holder, it doesn't apply to you. it applies to J1 holders who went back to their country and 2 years didn't pass. there is a chance still to receive it but there is a great risk that they will refuse. Just saying that everything needs to be checked

I want to clarify one thing first,
The scenario I posted is not mine, I just copied it from someone else's signature to present how things typically work ( timing may differ from case to case though).

DV2012EU000015xx is the case number I have. So our case numbers are pretty close.
Every month USCIS declares visa numbers in the monthly visa bulletin, and once your case number becomes available ( becomes current) in that monthly visa bulletin you can send in the required documents to get your GC process started. I am hoping the low EU1xxx numbers will become current ( in the visa bulletin) in either september or october. I don't think that you will have an interview date in October, if things works out fast you may have your interview in December, but it looks like we will have interviews in January.

Are you doing AOS? If yes, just make sure to send the form DSP-122 along with 2 passport photos and the barcode sheet. Also make sure to write BCIS in question #4 in DSP-122. I sent my documents yesterday via USPS firstclass registered ( $4.00 only)

When i called KCC the guy said that the numbers for october will appear between august and september but when asked if i should send then or wait october 1st, he said wait october 1st.
If someone would like to call them again and ask again that would be greatly appreciated, but as i said, several people already said that to me, so i'm waiting October 1st.
 
Yes you should definetly wait, because your papers will be rejected as the fiscal year did not start and you can not send them, you can only send them early during the fiscal year, for example if you are current in december, you can send them as early as mid october or begining of novemeber, but for october it is better to wait, trust me, I've been there and done that last year.
