hello

I have been notified by Kentucy Consular centre that i was among the selected people from the lottery , my case number is low and i am quite sure i will get an interview date

Lets say i do good in the interview and get the immigration visa

My boyfriend who has a B1/B2 - 10 years muntiple Tourist visa will accompany me to america.

I have a few questions:

1) Can i marry him in america before i get the actual green card in my hand ( i heard the procedure takes about 2 months) and will he be eligible for a green card too?

2) what if he is not eligible , how can he be with me in america as a alien or resident? any loop holes?

your suggestions will be appreciated

you can marry him at any time.

no, he will not be.

he can't and there are no loopholes.

Your only choice (a risky one at that) is to marry now, submit his docs in addition to yours, go to the interview together, be subject to a cross-examination (sometimes a tough one) to determine whether your marriage is a fake and was entered into for immigration purposes, and then - if successful, you will both get visas.

If there is a suspicion of a fake marriage, you will both be subject to a life-long ban on ever entering the US on any visa.

There is another option - following-to-join, however, it may also fall through due to poor timing, and it's risky as well.

In brief: you get married before you enter with your immigrant visa. Once you enter, you file I-824, when it's processed, you husband may or may not get an interview and get his immigrant visa as well.
The catch is that processing takes a long time, and he may not make it before Sep 30.
