Dumb Question:

I need a final clarification on this please:

I have an approved I-140 with comp. A, I work with comp. B now and would like to apply for GC from B porting the PD of my previous I-140 from A. Now if A revokes that I-140 before I apply from B, can I still port the PD from A's I-140 ?
Could the revokation of A's 140 affect me in anyway ?

Thanks

-----------------YES. when file second I-140 inform your lawyer to recapture early PD ( you need to provide him/her evidence od I-140 approval)

Could the revokation of A's 140 affect me in anyway ?
---------- if USCIS revoked it due to fraud then one cant keep that PD.
Thanks

There is no fraud here. But, just in case, if A wants to use that labor for some other employee and revokes the I140, will that have any effect on me porting the PD ?

Thanks again

Comp A cannot use an approved I-140 with another employee since that I-140 has your name on it. The I-140 ties you with the job on the LC.

one cannot use I-140 for another..but the underlying Labor can be substituted for others. In order to do that pururwa's employer should first revoke his I-140.

As per discussion with para-legal. They said you should be with A for 6 months. After that, even if A revokes 140, you can still use it for priority date from company B. Though you have to get labor and 140 approved from B too.

once I-140 is approved for YOU through any employer and you file second I-140 then you can recapture early PD.para-legal info is wrong you dont need to stick for 6 or 8 months, once I-140 is approved for YOU then you carry that PD.
para-legal is mixing AC21 and PD recapture.
