DS-230 question 40, Non Immigrant Visa denial

Hi friends,

If someone was denied non immigrant Visa (9 years before DV selection) probably because of no ties to his home country, Should he answer yes in question 40 f or NO?

The answer should be "NO", not unless the denial was based on a fraudulent misrepresentation on the part of the applicant. Having no enough tie to one's home country is not a fraudulent misrepresentation, unless the applicant submitted fake documents in an attempt to show that they have a strong tie to their country.
