Driving Violation and B-1 Visa

My employer is applying for a B-1 visa for me, and one of the questions being asked on the DS-156 forms is:

Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or similar legal action ? Have you ever unlawfully distributed or sold a controlled substance (drug), or been a prostitute or procurer for prostitutes ?

In 2003, I was given a ticket for an improper U-turn (New Jersey Section Number 39:4-125), and promptly paid the fine in the court. I do not have the payment slip / receipt to prove this fact. Does this driving violation have to be mentioned as an answer to the above question ?

I was on a F-1 student visa then, and returned to my home country (India) before my EAD expired.

Hi Rahul and Triple Citizen,

I am in a similar situation - I am on F-1 VISA and got a ticket y;day for a minor violation while on my bicycle. I will pay the fine soon (the citation is not yet reflecting in their system)

I will be applying for H1 in about 2 years from now - will that be a problem? Does answering NO to that question in DS-156 cause any problem - if they have access to the violation record - though I understand it is not a major violation, do they expect me to mention it there? My other fear is that if I mention, I may be denied VISA.

Please suggest or give more info based on your experience.

Mention the citation when the time comes. It should not be a problem.

Thanks Mr Ghori - But I am not sure when you say "when the time comes". In DS-156 form, should I say Yes/No to "Have you been arrested/convicted....?"

open container

I am on F1 visa currently on OPT ( h1 approved this year in April) living in Boston. I got a ticket for having an open container on the road in New york. I was not arrested,fingerprinted or photographed/ the cop gave me a ticket and i paid the fine as specified. The fine was 25$ and I paid it immediately

I will be going for stamping soon, so what do I need to be mentioning in ds-156 in response to the question

"Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or similar legal action ? Have you ever unlawfully distributed or sold a controlled substance (drug), or been a prostitute or procurer for prostitutes ?"

Because I paid the fine and plead guilty, will i have to answer "yes" to the question, were you ever convicted of a crime ... etc???

I am really getting worried if this would create a problem during stamping and I would be rejected ?

Anyone with experience or advice....??
