Does unavailability apply to if PD previously current?

I just read that EB3 visa numbers for all countries are unavailable, according to the July visa bulletin. However, my PD is April 2002, which became current during the May bulletin. So have I already been assigned a visa number (in May), or is it unavailable for me as well?

So I assume they are not going to process any cases at all in July, August, or September?

I believe
ppl who already filed they would be working as normal upto make approval decission once they decide approval they have to assign Visa number at that time file will be put on hold for final part of adjucant, once it available we would be seeing bulk approvals. :D

for new 485 filing, I believe they won't be accepting new 485s after this month,

It this is the scenario what is assumed above I hope that would help to avoid another backlog.

That is personal opinion I shared, and not necessary all should agree with.

"Shadyhtown" this is also learned that this time is oppertunity for ppl who are planning 'Shadi' in 'Town' or "Village" :D

Good luck keep ur hope high, You think good You will have Good. :D

I wonder if EB3 cases that are pending due to RFE will also not be adjudicated !!!

if this is the case, I might as well wait till October now.

I-485 RD 07/05/2002
FP 1 01/08/04

FP 2 07/01/05 (scheduled to go)

RFE received 05/10/05 and same standard message.

Of course it won't get approved - since they need a visa number to approve, and they're not going to bother getting a visa number until they get back your RFE response and look at it.

We will probably have to wait

waitingTSC1,

The reply to the RFE on my wifes 485 was received by TSC on the 4th of April. We have not heard anything since. I have a feeling that if it is not approved before the 1st of July we will have to wait till October. Its unfortunate but there is nothing we can do. Not sure why its taking them so long to take action after receiving the reply to the RFE.

regards,

saras

Hi Guys,
I know we are all so anxious with this unavailable visa numbers thing...It's just terrible.
I asked my lawyer if RFE cases would have any special treatment and get approved during the visa numner unavailable period. The answer was no. No visa numbers no approvals no matter what. So we can only expect a miracle before July 1, 2005 or freeze our anxieties and expectations until October....
Good Luck to all.
