Does she qualify for the lottery

Some friend of mine had a simple question to ask.

She gave birth in the USA this year on Mass Health insurance and now she went back to her Country. Does she qualify for the green card lottery if she applies.

What are the likely questions and should she include her baby born in the US when applying

The child can claim (probably has) US citizenship.

For the mother that makes no difference one way or another at this time. Later once the child is an adult, the child may sponsor the parents but that is a long time to wait.

Whether the mother is eligible for the lottery or not has not changed through the birth of the child. She must still qualify by education or work experience, pass medicals, prove financial stability and so on.
 
But she can also get a green card in other cathegorie than the dv for her being
A parent of an americain citizen...
And yes she can aply and she has to include all her kids doesn't matter where there are born
Just that if they are us citizen u don't need to take them for an interview obviously
They don't need a visa !

It will be 17 years before the child can sponsor the parents for a GC - so she should have a plan for the meantime...

Does she qualify for the GC lottery if she applies? A very good question and she has every reason to be concerned. She came into the US, applied for and received benefits she's not qualified to receive as a visitor.

If she applies and get's selected, a visa will not be issued to her if she turns up in the system as having received benefits she wasn't entitled to receive. If this information does not show up at the time of the interview and she has a successful interview, she still has to live in perpetual fear of discovery in the US. She will face deportation if this information later turns up in the system even after becoming a LPR.

A woman from an African country came to the US a couple of years ago to have a baby. With the help of her hosts, she applied for and received medicaid. Four years after having the baby, she went back to the embassy to apply for a new visitor's visa since her current one had expired. Of course she was denied the visa as she showed up in the system as having fraudulently applied for and received benefits she wasn't entitled to. She's going up and down today asking everyone for guidance of where to send the payment for the care to as she's able to pay. But then, the issue isn't whether one is able to make the payment now or not, she's basically facing a life time ban from the US.

It's an interesting point. Massachusetts has some sort of special insurance situation - but I think it is only intended to cover residents (legal residents I assume) of Mass. I'm not sure whether that would register as having received benefits in the same way Medicaid would have.

Perhaps there is more to this story about whether she was entitled to receive that benefit or not.
 
Agreed, Massachusetts has some sort of special insurance situation, not at par with Medicaid. And like you rightly noted, the number one eligibility requirement is that a person

must be a resident of Massachusetts to get any kind of MassHealth coverage. This means you actually live in Massachusetts and are not temporarily visiting here.

It does not sound like this person was living in MA either as a LPR or an undocumented immigrant, which would make her none entitled to receive this benefit. Of course because this isn't a federally fundeded program, the government may or may not go after her.
