Does I-130 ever expires?

I am planning as a USC to file an I-130 for my wife. She can not however adjust her status for at least three years, until her obligation with the VA hospitals ends. VA had sponsored her waiver and in return she has to work for the VA for three years at least before she is eligible to file the I-485.

If I file I-130 now, can we use the approved I-130 in three years time? Thanks for every answer.
 
130 has never expire, but why to hurry? What is the VA waiver?

Thanks for answering. VA (Veterans Affair Hospital) waiver is given for people on a J visa with a two year home residency requirement after their J visa expires.

If you read the I-485 form, question number 12 says: Have you ever been a J nonimigrant exchange visitor who was subject to the two-year foreign residency requirement and have not yet compiled with that requirement or obtained a waiver?

No need to file it now. For example, say her obligation ends on Dec 1, 2011. You can file her paperwork I-130, I-485 and all other forms on Dec 2, 2011. It doesn't make a difference when an I-130 is file, but filing it them as a single filing would save you hassle of USCIS screwing you with mistake. However, by the time she is ready to do AoS, the filing fee might be $2,500 :eek:. Also, by that time, you guys would have been married for over 2-3 years, which will ensure that she gets a 10 year greencard. I suppose the would have changed that to a 50 year card at $2,500...:)

Thanks for answering. And, we have been married since June of 2005. She was on a J visa than, now getting her waiver. Thanks anyway.
 
My understanding is that NVC will terminate an I-130 not acted upon one year after the PD becomes current.

NVC doesn't have that authority. They can forfeit the fees they collected and applications such as i-864, ds-230 will expire in a year after filing. See 9 FAM 42.41 N5
