Does H1b need to be amended because of change of company address !!!!

All,

My company changed its address in VA (moved about 6 miles). Do I have
to file a H1B amendment for this.

Also I have filed for GC (LC approved/140 approved/Waiting for 485 adjudication)...

Will this affect my GC ??

At worst, you may need to file a new LCA (Labor Condition Agreement) for the H1B. I was in the same boat as you and we filed one but I moved over 1200 miles. It seems possible that you may need to file one even for a 6 mile move just to update the company's address but you'd have to ask a lawyer / see if the USCIS site has information on when LCA's need to be redone.

Your GC is fine as far as it proceeding to approval (at this point you could even switch to another company with a similar job under AC-21 as long as your 485 was filed > 180 days ago). Again though, there may be a form that needs to be filed to update the company's address.

This probably didn't help much but maybe someone else will have more detailed info... :).

My company changed address 5 miles to new place, around 3 years back.I did not file for change in LCA amendment, got my H1 approvals also with out any problem, only problem that happened is INS send duplicate copy of approved I-140 to my company's old address, lawyer says it's not a problem ,as lawyer already got another copy.

DOL has insisted that if the employer's name or tax ID # changes, then in essence there is a new employer, and the employer must file a new LCA.

My companys federal id no and state id no is the same...at least thats what I see in the W2 for 2004 that I got yesterday ....
Now is this id the same as tax id ??If not what is tax id no ???


....Company name has also not changed..... Company has just moved about 6 miles..due to lease expiration
