Does CSPA Apply In This I-130 Petition?

Hi all, does CSPA benefit her in the following situation?

Her uncle is a US citizen, and filed an I-130 for her father. Priority date
was 11/25/94, and it was "approved" on 03/03/95.

She was born on 11/06/81, and is currently on H1-B status working here. Her
father and mother are currently in Hong Kong.

From the Visa Bulletin, it seems like that the visa will become available in
about 13 months. By that time, will she be able to benefit from the CSPA?

Even if she cannot get PR status at the same time as her father, will her category be changed to 2B automatically and retain the original priority date ie 11/25/94?

There are so many people who want that this should happen!!!
Till now, unfortunatel, it seems that derivative children do not go to the next, F2b category.
My daughter is in the same situation. Our priority date will become current in about 3 months, and she will ageout next month

Anyone who has a child that is or could be affected should write to their congress person / Senator /DOS/ DOJ etc

I am trying to get as many people as possible together with case details to go to the media either before christmas or in the new year

My attorney has raised my sons case with the liasion commitee at AILA to see if they can lobby for a legative fix

The way I see it is if we do nothing then all could be lost for so many families and implications do not bear thinking about
