Hi all, does CSPA benefit her in the following situation?
Her uncle is a US citizen, and filed an I-130 for her father. Priority date
was 11/25/94, and it was "approved" on 03/03/95.
She was born on 11/06/81, and is currently on H1-B status working here. Her
father and mother are currently in Hong Kong.
From the Visa Bulletin, it seems like that the visa will become available in
about 13 months. By that time, will she be able to benefit from the CSPA?
Even if she cannot get PR status at the same time as her father, will her category be changed to 2B automatically and retain the original priority date ie 11/25/94?
