DOB Certificate

Does anyone got the DOB certificate from Indian Consulate General in US.
I do not have the DOB certificate and thinking to get one from
Indian Consulate in New York.
 
A friend of mine has just sent in his PP to Indian Consulate in NY. He says they charge $20 and you can get it in about 2 weeks.

Does BCIS accepts that Cerificate issued by Indian Consulate in US.
My attorney says that BCIS only accepts the ceritificate issued in the hometown in India.

I am not sure about that but it was also suggested to my friend by his attorney to obtain it from Indian Consulate. Logically, it is from Indian Government and I think they do all the backtracking and should not be a problem for BCIS

--- Your attorney is correct, you need a DOB issued from India, if it is not available get 2 affidavits from your parents or relatives signed before executive magistrate or Notary public on 10 Rupees Stamp paper, it should state your father name, mother name, Village/ city where you were born, date of birth and that the Birth of child (you) was not recorded or available with the proper authorities and they have made request to proper authorities + you need NON AVAILABILITY CERTIFICATE, it can be obtained from Municipality, Gram Panchayat, or District Registrar of Birth/death record office, Non availability certificate has to be signed by officer and should have SEAL, date. Once you get that Non availability certificate it will be in Indian language, go to any notary in India let him translate it in English and get the notary stamp on translation as “Translation of the original… get 2-3 copies stamped by notary, submit 2 affidavits+ non availability certificate with your I-485 (you need to submit copies only) keep the original affidavits and Non availability certificate with you. Birth Certificate issued by Indian Consulates is a letter which says that the date of birth of Mr. XXX is DDDDDD as per his passport. Now if BCIS does not accept passport as a proof for date of birth, wht should it accept such a letter from Indian consulate?
 
We failed to obtain "non-availability' certificate from local municipality or district office. They say that they dont' issue non-availability forms.

Wondering what next? Is it a must? What will BCIS do if they dont' find non-availability? I have already filed concurrently with just affidavits.

--- Get a letter from Municipality or District registrar that they don’t provide non-availability certificate it should be signed with official stamp and date,( I hope you did not give then "Chai Pani ")that will work and your lawyer can explain when RFE is generated

I asked for similar letter that they don’t provide non-availability. But they asked why should I give that letter. Finally i went to court. In court they provided the birth certficate. It took four months to get that.

One of my friend paid Rs 500 he got it within a day.

You should have asked Why he should not give that letter, show me any law that says you can not give such letter, you should have noted his name and should have gone to higher authority,( but who has the time) I have seen that once they know it is for America they want Chai Pani, better is to tell them it is needed for job in India. In Punjab, Gujarat and north India they know what is the use of the letter and ask for bribe. This kind of situation is better handled by a person who regularly visits courts, municipality, they know how to handle the situation.
In Bombay it seems more difficult but if you have contacts you can get Non Availability certificate in 1 day from your Municipal ward officer.
One of my friends recently got Non Availability certificate from Punjab side he paid 1000 rupees and in 1 hour the certificate was in his hands
