Do I Have to file an ammendment to my H1B visa??

Hi!

I am working for a university as a reporting analyst (full time - budgeted position) on H1B visa since Aug, 2003. Before that I was working in the same job on OPT for an year. During that OPT period besides this job I used to teach some classes in the evening for which I got paid through the same payroll in one check (my full time job salary + pay for the classes I taught). Now after I transferred my visa from F1 to H1B, one of the colleges (part of the university under same payroll department) for whom I taught classes is asking me to teach again part-time in the evenings. My full-time job responsibilities of my H1B visa doesnot include any words like "teaching" or "training". If I want to teach part-time now, does our university or me have to file an ammendment to my current H1B visa. Our HR department is not aware of the rules applying to this kind of situation.

Please advise me on this at the earliest possible convenience for you as I need an answer by this friday.

Either they can file an amendment or they can do another part time H1 specific for teaching duties.

Thank you very much for your advise. I have two more questions related to this issue.

1. Do I really have to file an amendment? (I was thinking ...is my case not similar to the employees who work for consutancies...who change their job duties quite often..when they switch to different projects). I also want to mention that the classes I have to teach are in the Dept of Computer Science (Programming classes) and even my fulltime job is related to programming.

2. If I have to do the amendment or a part time H1, what happens I don't teach continuosly...the reason I am asking is ..this is an adjunct faculty position..they assign me classes as needed...in some semesters they may not assign me classes at all. During that period, I will be working only on my primary H1 visa. Will I have to inform INS whenever I stop teaching and again when I start again in the next semester.

No, consultancies dont change job duties (programming in a different language/package is not changing job duty).

In your case, if your primary H1 included teaching duties then go ahead and take the part time job.
Since it is not continuous, PT or amendment is the legal assurance.
