Well, I'm legally separated from my spouse about a year ago !

There are some questions that I have while filling the forms given in the NL :)

Question 9. (DS-230) : Well, what are exact differences between Divorced and Seperated, and (I've married once and terminated it once) so I must write "1" in the 2nd part ?!

Question 14, (SD-230) : As far as I don't have any spouse right now, shall I live these fields blank or shall I write my former spouse's info or ... ?!

Hi dN3tGuru,

I guess you're waiting answers from people who are in the same situation.
As for the difference between divorced and separated, it depends on if you filed divorce paper with the court.
Separation is a situation in which a husband and wife agree to live apart even though they are still married, in general.
But, they explain the term "legally separated" in online DV application form that a court formally declared that you and your spouse are legally separated. Legal separation means that your spouse would not be eligible to immigrate as your derivative. They use the term "Legally Separated" for online DV-2008 application. In other words, in my opinion, if "Separated" is chosen as marital status on DS-230, spouse cannot immigrate.

In your case (assuming you are divorced once, and single now), I think "1" would be appropriate answer.

In other cases, even if current marital status is "Divorced," "2" is possible for people who got married twice, and divorced twice. Also, even if current marital status is "Married," some people will write "2" if they've divorced once. They are asking how many time you get married.

Hi dN3tGuru,

I hope you already found answers for your questions about Q9 and Q14.
I just noticed a few things. So, I'm writhing this in case you are still seeking for answers.

When you applied for DV-2008 last year, which marital status did you mark, divorced or legally separated?
They explain "legally separated" means that a court formally declared that you and your spouse are legally separated.
Legal separation means that your spouse would not be eligible to immigrate as your derivative.
Also, they didn't ask any spouse info unelss you checked "Married." They write "no spouse info required" to other marital status.
In my opinion, it implies that you don't need to give your ex-wife's information for Q14 on DS-230. So, just write "N/A" :)
