I am a Canadian Citizen in the US on a TN visa. I have a wife from China who came to the US on a TD visa. Things were not going well in our marriage so we separated from each other. However, to allow her to stay in the US, I didn't file for a divorce. Since then, I have met someone else and we are considering getting married, so I would like to divorce my wife. She will most likely not leave the US and return to China when this happens. If she overstays her TD visa, since I was sort of her "sponsor", would this hinder my status in the US - especially when I apply for a green card later on.
