Dear All,

Would appreciate some advice. I am applying for a green card based on marriage to a U.S citizen. I am currently married in my home country and if I start the divorce process now it could take 8-10 months before I do get a divorce certificate. Do you think that if I was married and divorced outside the U.S it will be noticed if I do not enclose a certificate? Additional information is that as a foreigner I do file U.S taxes on my property in the U.S. In the tax return I am disclosing my spouse's name.

Would USCIS cross reference IRS records? To clarify I do not mean to be dishonest just am very worried about having to wait 8-10 months.

are you married to US citizen AND still married to spouse in your country (2 spouses at the same time) ?
Or you are married to US citizen, applying for green card and want to divorce already? If you are applying for GC based on 3 year marriage to US citizen, your spouse must go with you to interview..

It sounds like you married to US citizen but haven't divorced your spouse in other country. If that's the case, you will need to show them a copy of your divorce. It's not legal of course. Did you already applied for GC?

Sorry if I was not clear. My current wife and I are separated but not divorced. I met a U.S citizen in the U.S and would like to get married ASAP so I could start the green card process. Of course I will divorce my current wife but it takes 8-10months to get a divorce certificate in my home country.

Do you think I could get married in the U.S, start the green card process now and because I never had got married in the territory of the U.S before I would not have to show a divorce certificate?

Yes, you could. You need to understand that is a crime in all US states though. You could face long prison term.
 
you can't get married in US until you have your divorce paper from your home country signed by judge and in your hands.
 
Dangerous

The US Ambassador in your country somehow has access to your personal profile. My brother went to a interview for a Student VISA in his country and they already knew he had a brother in the US. My friend also went for the same interview, and when they said if he had any relatives in the US, he said no, then the interviewer showed him a list of his aunts, grandfather, and grandmother; of course, he would never be able to come to the US again.
So I would not be surprised if they know you are already married in your own country.
 
I don't think USCIS contacts Ambassadors and pulls all the info of people adjusting status in states.
USCIS scans all documents when they receive applications from us, and after 6 months deletes everything.

That would be bigamy and would get you deported if the US government found out. They probably already know about your marriage; you were supposed to tell them about it when applying for whatever visa you used to enter the US (unless you got the visa before marriage, or you have a passport which exempts you from needing a visa to enter the US).

They don't do that routinely, but it's easy for them to find out if they want to. Marriage records are usually not difficult to obtain, and are public records in many countries (including the US).

You statement really disturbs me! Your main motivation for the marriage seems to be the green card from the statement you made below.

Anyway to answer your question, you can do anything you want. Just remember that the arms of the law are very long and sometimes can reach into the distant past.
