Detailed Visa Appointment Procedure - Emergency or Otherwise

Appointments' procedures for all non-immigrant visas are the same. This is from my personal experience in Nov 2005.

Step 1.
Make the two payments - either by DD or cash at the designated branch of HDFC bank. Take copy of passport along. Get receipt of the payment. There'll be a barcode sticker on the receipt which will also have the number which will be your receipt no. for all future references. This can be done by the individual applying for the visa or any representative but should carry the Passport copy of the individual travelling.

Step 2.
Wait for two days. Be patient, dont do this before 2 business days. Then go online to http://www.vfs-usa.co.in and click on "apply for a non-immigrant visa". Fill up all the details to create a new application. You will not see emergency dates, instead you will see the regular availabe dates only. If you are applying fir emergency situation, dont worry - complete the form(s) and at the end you'll see a button for "Emergency" application. Note that you must fall under the emergency appointments criteria which I am listing at the end of this posting. Choose the type of emergency and then you will see the earliest available EMERGENCY Dates.

Once you are done getting the dates, remember to fill the DS156, DS157, etc. forms online itself. Remember that for address on the forms give your permanent India address.

Step 3.
Fill out all the forms and gather documents. Note - these are documents for getting appointment and not the ones to take for the interview. These are:
a> Valid passport.
b> One photograph as per specification (note, mumbai's VFS has a photo booth inside the office so no need to get it done before hand although I'd advice to carry your copy)
c> Original signed form DS-156 (printout from the web) (remember to print this form back-to back on one page only)
d> Original form DS-157 (printout from the web)
e> Original form DS-158, if applicable (printout from the web)
f> Original, valid HDFC Bank visa fee receipt
g> Demand draft for Issuance Fee (has to be DD, no cash here)
h> Appointment letter (printout from the web)
This has to be done 5 days before the appointment

Step 4
Go to conulate for interview (do not carry any bags or any other stuff except your papers in a plastic bag.) Nothing digital NOT EVEN DIGITAL WATCHES (I had to give away mine to a stranger for fear of loosing my appointment)

Step 5
If approved pick up the passport the same evening at VFS center or get it in courier in a few days. I'd suggest if its so much an emergency, pickup personally, dont depend on the courier.

Step 6 Optional
Relax and have an ice-cream at a nice restaurant :)


NOTE these are steps for online processing. If you at anti-internet and want to do it personally then skip Step 2. Instead fill out the DS forms personally. Then in step 3 carry all these documents and personally go to VFS to schedule an appoint as well as submit the documents. Now here since you've not scheduled you appointment, you'll have to do this as early as possible.

(Dis)Advantages?? Not aware of but here's what happened to me. I scheduled my emergency appt. online and then went to VFS requesting an even earlier date and the person over the counter said that since I got the appt online, there's nothing that they can do. Now, I dont know and am not sure if had I schedules the appt. personally, would they have been able to help me out.

I'd suggest (and my personal suggestion) if you stay nearby ( say in and around Mumbai) do it personally, I feel that gives you more control - Probably. If its online I guess, it directly goes into system. BUT on the other hand online is clean, simple and less hassle.

Here are the Criteria for emergency appointment:
A. Medical Care: Purpose of travel is to obtain emergency medical care, or to accompany a relative or employer for emergency medical care.
Essential documentation:
- A letter from the doctor in India describing the medical condition, such as the urgency of the need to travel and certifying that such care is not available in India.
- A letter from the physician or hospital in the United States indicating that they are prepared to treat the case, and providing the approximate cost of the treatment.
- Evidence of how one shall pay for the cost of the treatment.

B. Funeral/Death: Purpose of travel is to attend the funeral of an immediate family member (mother, father, brother, sister, child, grandparent or grandchild) in the United States.
Essential documentation:
- A letter from the funeral director stating the contact information and details of the deceased and date of the funeral
- Evidence that the deceased is an immediate relative

Please note: If the travel on account of Medical Care of Funeral/Death has to take place within the next 3 days, please e-mail ceamb@state.gov. and put "Medical Care" or "Funeral/Death" in the subject line

C. Business: Purpose of travel is to attend to a business matter where the travel requirement could not be predicted sufficiently in advance.
Essential documentation, as applicable:
- A letter from a BEP member company with proper authorized signatures on file with the consular section.
- A letter of invitation from the corresponding company in the United States attesting to the urgency of the planned visit, describing the nature of the business and that either the US or Indian company will suffer a significant lost opportunity if an emergency appointment is not available.
- Evidence of a necessary training program in the United States of three months duration or less, to include letters from both the Indian employer and U.S. company providing the training.
- Contracts, letters of credit and/or other documents demonstrating a business relationship and a need to travel urgently.

D. Students and exchange Visitors who are within 90 days of their start date of a valid programme as indicated on their form, and who have not been refused a visa within the last six months can use the emergency/priority scheduling online.
Essential documentation:
- Form I-20 or DS-2019 indicating start date of programme within 90 days.

E. Workers. If you are already working in the U.S. and are returning to your job you can use the emergency/priority scheduling online.
IMPORTANT: Emergency appointments can only be given to first time applicants for an H or L visa if they are returning to continue their employment, for instance after a change of status to H or L while in the States. Dependents do not qualify for emergency scheduling unless applying at the same time as the principal.
Essential documentation:
- Evidence such as a previous visa, form I-797 or I-129 to demonstrate that they are returning to their previously authorized employment in the United States and proof that employment is authorized.

IMPORTANT:
Emergency appointments can NOT be given to travelers intending to attend a wedding or graduation ceremony, nor to first-time applicants for an H or L visa traveling to the States to START employment.

what if I want an appointment in a different language. Can I still take it in English and request for a different language during the interview. The reason I am asking is that, the dates for different languages is coming as un-available.

I am working in the USA for 6 years already, I have to go to India to attend my divorce court appoitment and I need to get back to my job within 15 days, the appointment is in february and the current normal appointment date is April. Do I qualify for emergency appointment?

I have already stamped my visa once in the USA in 2003 after getting the original stamp from India in 2000.

Can anyone please clarify?

I applied for my H1B visa(2 months now).

1. I did not get my Visa but can I book the appointment using vfs?
2. What are procedures/requirements to pay the visa fee in HDFC bank?
3. Anywhere in booking the appointment do I need to give my Visa validity period? (I don't have one right now)

U can't change language at interview. So make sure u take regional lang. eventhough its not easy to get one.

I am trying to book an appointment. However, from Step-2, could you help me understand if we can book an appointment now, but fill out the DS-156, 157 after a week or so? In other words, is everything cast on stone once you confirm a particular date or can we go an update the DS-156 and online forms if we need to?

You wont get an appointment date unless you fill up all the forms. So you have to any how fill up the ds156 and ds157 forms first.

so once you fill forms and then get the dates, you can always go back to your application and change the data in the forms as you wish. But you have to print the forms and then submit them to the VFS 5 days (or more) prior to your appt date. Once you submit it - then there is not going back and changing the data.

What I meant by the statement "Once you are done getting the dates, remember to fill the DS156, DS157, etc. forms online itself. Remember that for address on the forms give your permanent India address." is that once you are done looking at the available dates, fill/modify the forms online itself.

Thank you for the great information on the various steps.
So when one tries to see the emergency appointment dates without first paying the fees, etc. one would not get a clear picture.

How long did you need to wait for emergency date? When you seek emergency appt, does the system generate the first date available (all the 4 consulates\embassies considered) or it will generate such a date only for a particular consulalte that you had to choose before hand?

Also, are there any means of making the payments of fees, etc. online using credit card (useful for US residents) rather than having to rely on some rep in India to help you out?

I am in US for last 7 years and have not gone back to India in last 3 years. I have stamped in India many times during 1999-2003. Now the visa on my passport has expired. Also in the mean time I have changed the company. Currently I am on 8th year extension. I changed company when I was in my 6th year. Now I am planning to go back to India for vacation. From this forum, it loooks like I should be able to get an emergency appointment as I am just going for 3 week vacation in Jan end 2006 and will come back in mid Feb2006.
can some one confirm that it is okay to do an emergency appointment in this situation?.

Also since I am in 8th year extension, will there be any problem in visa stamping or taking an emergency appointment for 8th year extension?.

1. Yes, you wont get a clear picture of the available emergency dates untill you fill up the forms and come to a stage to schedule an appointment and thats possible only when you pay your fees at HDFC first. This was done to avoid people taking unnecessary appointments and blocking dates.

2. When I got my stamping done, the regular date available was mid Feb 2006 and the emergency date I got was 8th November 2005 - so a difference of about 3-4 months - that's pretty good, I'd say.

3. No, the systems generates the dates for the selected consulate in selected city only - 'cause I guess, you are not eligible to apply in a consulate which does not include your town/city in its jurisdiction.

4. I am not sure but as far as I know you cannot make payments ONLINE, but the initial payment at VFS can be a DD or a cashiers check or CC or Cash. The second payment to the consulate has to be a DD or a cashier's check

You can get an emergency appoint provided you qualify for the criteria, in your case, your company needs you to start work ASAP so thats a valid emergency - just remember to take as many letters and certificates proving that you are working and you are wanted back by your company ASAP to resume your work.

6. When I went, I was in my 7th year so its perfectly OK, legal and normal to do as long as you have valid papers and H1 petition.

I have fille the DS156 and DS157 form.
I do not see any button for emergency dates.
I see button for submit.
Do I need to submit these before I would be able to see the dates?

Hi,

Yes, you have to submit first - once all the documents are filled up - it gives you a list/table of regular current dates but below that there is a link to emergency appointments.

Thats how it was when I applied a few months back and I feel it should still be the same process.

But which consulate's jurisdiction does one belong to if one has been staying in the US for a while?

I am planning to take emergency appt . Let me know if I fall in it.
I am working in US on H1 for last 1 yr and H1/I84 is valid till Nov 2008.. Earlier I was on H4 . I want to go to India to attend my brothers wedding in May. I am currently on a project and the project is ongoing, so I have to come back after the vacation and start asap..

What docs shud I carry and will I be fine if I take emergency appt. Please advise.
 
HDFC Bank visa fee receipt

Thank you for your detailed post and responding to our queries.

I have 1 "Original valid HDFC Bank visa fee receipt". (which I got after paying 4600/- before taking appointment).

After taking online appointment at Mumbai, the list of documents to be submitted via postal mail, indicates original "HDFC Bank visa fee receipt" needs to be submitted.

Also in documents to carry on day of interview its mentioned to carry "HDFC Bank visa fee receipt".

1. Is it ok if I carry xerox of HDFC Fee Receipt on day of interview and submit the original in postal mail.

2. Have I missed getting 2nd copy from HDFC bank ?

Mumbai Consulate procedures different from Chennai

It looks like the posting from Saroshdara is w.r.t the Mumbai consulate. As per the chennai consulate website, there is no need to pre-submit any forms. You just have to carry everything with you on the date of interview. Is this correct or am I missing something?

Regarding somebody else's question about HDFC bank receipts, I paid money at HDFC bank just two days back and I got two receipts from them.

One receipt that I have (for 4600/-) reads "Embassy Copy" on bottom right corner.

I got two copies from the bank after paying 4600/-. One copy is pink in color and has one barcode sticker on it. That says Applicant's copy. The other one is white in color and has two barcoded stickers on it and it says Embassy copy (to be submitted to the embassy).

I was able to follow your instructions and could get an appointment for the month of September.

Just so you guys know that I am going for an Interview in New Delhi. As per what i have read on the ImmiHelp website I think pre submission of forms are only valid at Mumbai consulate not in New Delhi.
My below questions are asked based on my limited knowledge of pre submission and differences of visa revalidation procedures between New Delhi and Mumbai.


I have some Question regarding the Documents to be submitted to INS before
interview.
