Derivative asylee and travel (Urgent)

Hi friends,

I am a permanent resident through derivative asylum. My dad was principal asylee. I got my green card a year ago. I HAVE to go back to my country of prosecution to get all my education, community service, and employment records. I applied for RTC through an attorney. Do you think I will get the RTC ? I am little worried about not being admitted again. If I bring all the proofs, I hope I will not have problems. My parents and a sister live here in USA.

Do you have a fear of returning to your country, or was your dad the only one who was really persecuted? Can nobody send you these documents? And, do you have a valid national passport still?

The answer to this question is not straightforward. As a derivative, you have a MUCH better chance of not being given any trouble when you return and when you interview for citizenship. You might or might not be questioned about this trip. Most of the time, no questions will be asked, but if they are, it'd be good to have a reason for your trip, such as an emergency. So, have a good reason, and go with your national passport. Technically you don't need an RTD once you have a GC, and you can also apply for a Re-Entry Permit that'll be valid for 2 years.

Thank you for your reply. The political condition of my country (Nepal) is worse than ever. However, my dad was the one who had life threatening condition, and fled away. Later me,my mom, and sister joined him in USA as derivatives. I personally have very less fear.

Nepal has very poor communication system. They don't do works by email, fax in many places. I have to go there and pay money to get my original certificates. I have done several community service, and I need the proofs too. The main purpose is that I am planning to enter a pharmacy school (doctor in pharmacy) next year here in US, and I need the documents to strengthen my application.

I asked my attorney, and he signed a RTD for me. I have mentioned my reasons clearly using an additional sheet in RTD. First of all, I am not sure if they allow me to go back. Second if they do, I hope I will not have problem while entering because I will have all the documents with me. LoL...and they would not want to kick me out because I have 7000 dollars in student loans from government already haha :P

More suggestions are welcome !
 
So, you're ok. You don't need an RTD. Just use your passport. CBP often tells former asylees to use their passport once they are LPRs.
 
I already applied for the RTD. My attorney told me to get the RTD. I think I should use passport while going back to Nepal, and show RTD back in USA port ?

Your lawyer doesn't know what he is talking about. YOU SHOULD NOT HAVE APPLIED FOR RTD. The I-131 adjudicator might document your reasons of your visit and enter some notes in the system that might cause unnecessary second inspection when you come back. You don't need RTD if you have GC, national passport, and you were a former derivative asylee.
I hate those lawyers who give wrong information.
 
I think you people are right, but I am supposed to trust that guy too. We have been with that lawyer since my dad's asylum application, his green card application, our family asylum application, our family green card application. Everything has been fast and smooth with him. So, I asked him what should I do about that. He told me don't go until you have to. If you have to go, do make a RTD...Hence, I obeyed him. I have a green card and valid national passport, but just wanted to stay in the safe side. Btw he is a lawyer who has been practicing it since 20 years in Maryland.
 
Ok you applied for it, but you can go now probably. If Nepal will let you in (and does not have a warrant for your arrest, etc.), then chances are if you go and come back quickly with your passport and GC, you will be able to explain this trip. When did you become an LPR?
 
Hahaha why would they arrest me, but you cannot trust that country. There is no rule of law. I will have to use passport to enter because I don't want to get into trouble by letting those people know I am a refugee in USA. When I return back, I will show them the passport. Thanks for your dedicated involvement cafeconleche. I am going to wait, and stay in the safe side :) What does LPR mean ? If you mean permanent resident, I became on December 2009.
 
LPR is lawful permanent resident. We use that acronym among others on this website:

GC = green card
RTD = refugee travel document
RP or REP = re-entry permit (you could have applied for this too, as it would have been valid for 2 years), though it is called the permit to re-enter (PRE)
NP = national passport
COP = country of persecution

There are more probably, but these are the most important ones. You really don't have to wait for your RTD as you're already going to your COP, but sure, wait for it. Just don't let the Nepali authorities catch you with it. I'm sure that would be a bad idea, especially if they know what it is.
 
ok, guys, please help me out! i'm confused!:))

i'm derivative asylee and i have received my GC. I am planning to travel next year but I dont know what to do. Places where I am going to are: Bahama, Germany, Spain and COP of my husband.
what do i need in order to visit those countries: GC+NP or GC+RTD or GC+NP+RTD?
