Deportation Question

Hello everyone!
I just wanted to ask if anybody heard how this works in real life. If after all courts and appeals they will still issue a deportation order, I know that asylum applicant has a choice to be deported to a third country!

The US goverment is gonna look for the country that is ready to give you a status with no questions asked or after they deport you the third country can deport you too?? Are they gonna give you a list of countries??? What if you refuse to be deported to certain third country, are they gonna arrest you??? It's very interesting how it really works!!!

My case is i still in courts, but if one day after all my appeals they will order deportation I will definitely ask them to be deported in a third country. I wonder if anybody heard or have friends who went thru such procedure!

My uncle was picked up from his home to be deported..His story made news on newsweek etc. During his detention, our family contacted Canada, London, Germany among the countries asking them to grant them asylum but the embassies refused. Even DHS said we will send them back to thier home country and then they can go wherever they can get a visa to.

So no DHS doesn't look out for you if you are thinking. We got lucky because my other uncle knew a senator in PA since he was his physican and lots of faxes and media attention got them out of detention.

They had been denied as far as from the Supreme Court. Now they are in Temporary Protection with their case being heard again hopefully this year.

That third country has to affirmatively agree to take you. Otherwise the US will deport you to your country of nationality or last habitual residence (if you do not have a nationality for some reason).

Try to think positive. By the time your process is over mayby Congress will have passed amnesty legislation (especially if the Democrats win control of Congress in November).

As far as i know amnesty is usually is for illegal aliens only. How does amnesty concern people with pending asylum???

You obviously did your homework and raised a very good question.

The answer is that when the government implemented the last amnesty (in the mid to late 1980's) the INS General Counsel interpreted the law to mean that people with pending asylum cases were deemed to be in illegal status for purposes of amnesty.

Are you saying this person was formally deported by the Government and then came back illegaly? Well, this is a federal criminal offense and people receive prison sentences for crime.

I am dead serious. This is a very serious matter.

I hope I am not being rude by taking you up on your offer to help Michail. I just don't know where to turn. I am new to this site, so I hope I am doing this correctly.

Anyhow, here is my situation. I am a USC. A year ago I fell madly in love with an " undocumented alien" who entered this country, over 10 years ago, illegally. About 7 years ago he went back home to visit his family and upon his return, was detained and "deported". He managed to make it back in and has been here ever since. He has never been in ANY trouble what-so-ever. He doesn't even drive so as to avoid any temptations to "break the law".

His FBI fringerprint file is clean. But the "deportation" does show on his ins/CIS file.

What, if anything, can be done to make his status here "legal"? We want to marry and start a family but I am horribly affraid of the instability. We have talked about immigrating to Canada. I just want to exhaust all options here before going down that road.

Any advice?

Thanks for responding. What is done, is done. Can't look back. There were extenuating circumstances why he had to return ( in whatever staus).

I appreciate the severity of the issue. Hence my concern. He isn't the only one in this country in this situation yet he is the only one I want to make my life with. Catch my dilemma? Anyway, no worries. Thanks for your time.
