Dependants of TN renewed via I-129.

My current TN and TDs of my family are valid till the end of Augut 2009. I am planning to file my TN renewal via I-129 in the coming week i.e. 6 months before the expiration. My family is planning to visit abroad between June - Aug 2009. I will join them later and will be accompanying them when they come back to US in Aug. Is it required for me to file a I-539 for them along with my I-129? What would happen if we simply request a TD renewal at POE in Aug based on my new I-94 when we all come back since they would still have their old TD valid for another month? In that way, I could avoid paying an extra $300 for I-539 processing. Please let me know if that is possible or would it create any unnecessary issue/complication?

Also, is it possible for a TN holder to travel back and forth to Canada on a valid I-94 while his I-129 is in process with USCIS?

As long as they return to US after you have obtained your new TN, they should be able to get their TD at the border. You would only need to submit I-539 if they get to August wiuthout new I-94.

It's TNs thatwon't be renewed at POE until close to expiry. TDs can always be obtained to coincide your then current TN.
 
Thanks!! So I am assuming that the answer to my last question about tn holder traveling to Canada with a pending i129 is yes.
 
So you are implying that it is the requirement for a pending I-129 application not to travel on a previously issued and still valid I-94?
