Delayed filing for change from H-1 to F-1

Hi,

My friend had a H-1 visa but was laid off from my company a few months ago. He went back to school and filed the paperwork to convert to F-1. However, due to a delay on the school's end, the school did not get the paperwork to INS on time and he may not get his F-1. What should he do??? He's not done with school yet.

what kind of paperwork did the school not get to the INS? ONce the person has I-20, he himself applies for a change of status. Once he applies for a change of status he is in legal status until it is approved or denied.
 
Apparently, he had to go through his school to get his I-20 first, but someone retained his documents, saying they need to check on something and will send them on to the INS. They never did. So now my friend is getting a letter from the school verifying they had the papers with them all this time and is appealing INS to reopen his case.
