is your company ,based in DE,and you are working elsewhere,or they have a branch in DE?
Rincytom your application was filed on March 02,mine was march 5th,my company hasn't received information from the lawyer yet.They might have been told to withdraw the application though.

Did u ask ur lawyer abt this NOF issue? Whats the setup of ur company in DE? Is it the main office or a brach office?

In general, has anyone's lawyer heard anythin from INS about the NOF?
 
My company HQ is NJ,branch in DE,had some past business in DE,don't know about right now,and i work in VA.
Have a friend who is in a similar situation as above,except that he works in NJ,lawyer is Sheela Murthy,and their office recommended to withdraw the case.Seems like if there is a NOF,and it's replied to,and gets rejected can be lots of complications,even criminal action for a wrong filing.

Am not sure about the last part,essentially they asked him what he would like to do,and he elected to withdraw the application.
The one thing which is not clear to me is whether the company or individual is more at risk.

What happened at your end? Did u withdraw or found another way out?

The only risk the company has that it would have against its name that one LCA got rejected (for whatever reason)..thats their only risk. the consultant's risk is that he cannot file Labor in any state for another 6 months and there (might) be complications.
Sometimes I feel, the lawyer's overreact and as companies are generally scared of INS and queries/inquires, they resort to a simple withdraw ur case.
I am in a similar situation but trying to fight it out..I have not seen (yet) at any INS websites that there has been a change in law and now software companies require u to file GC from corporate office only.
Strangely, everyone is quoting Sheila Murthy's website..how authenticate is that information anyway? I read the article posted on her website but strangely there was no links or references to the INS website.

I agree with what you say,at my end i'm trying to figure out what is going on,and what my company plans to do.Don't know if at the end of the day,decision is the company's or the individual or both.
I'm probably going to elect to pull out,as i'm looking to join another place and file with them.

I am just off the phone with the arorney.
He said he didnot receive any info about my case from SESA. I asked him whether he received any RFE/NOF on my case. He said no.

Do you have any updates about your case. Mine also filed in second week of march.

On march 5th 2004 one case moved to federal from my company and that case was approved by federal on march 25th. When I asked my lawer he told he didn't receive any information about that case .

Labor issue with delaware

Just an update guys,

My compnay too had filed from Delaware "42 Reads Way" address. And they say that they have replied to INS quries and it takes 45 days to get a response.

Looks like only a handful of companies are responding to the quries.

Maybe sometime in first week of may I might get some info.

Update you guys soon.

All the companies with this address get rejected ?

My company has filed from same address but they pay all taxes and runs payroll from that location.

Can it be a problem ?

do you know when this case was filed?was it a march case?it got approved by federal in 20 days??wow that's really fast.

Sam6,

Actually 3 other cases from my company which are filed on feb27th,28th of 2003 which are moved to federal in dec 2003 also approved on the same day( march 25th 2004).

Hi DEEPFOREST,

I am following this forum only from the last five days. My LC was applied from DE in May,2003. My employer has HQ in NJ and a branch in DE. My LC was filed on the basis of future employment.

I was just checking processing timings in the DOL website until the sponsoring employer called one day in April and said he got doubts about my case. I was stunned. Then I started checking websites, forums and all and I came to know that I kept my eyes closed. I am too desperate to get LC since I got only 10 months left on my H1b.

My case is with Philly DOL right now. It went there in March,2004. For some reason I got a feeling that both of us might be applied for LCs from the same employer. My employer too got a small office in DE and there is one person to answer the
phones and all.

Can you please post in this forum if you get LC clearance.

Thanks for hope. We are on the same (sinking ???) boat.

(1) How can I find out that my case is moved to Phily ?

(2) You said some people replied to their query and they got labor cleared. Do you know anything detail about that ?
