I have entered the US for first time in 1998 on F1, then got my H1 in 2000 and went to India in 2001, got H1B visa stampin July 2001 in home country (India) and then came back in August of 2001. SInce then I have switched two jobs and my lastest H1B has been applied by my current employer in May 2003 and got the approval. But there is an error on the year of my Date of Birth on I94 on the bottom right hand corner of approva notice and my company has actually mis typed on I129 while sending it
My past H1b stamp on my passport has expired on 1st October 2003, and now I am planning for a trip to India next month (very important personal trip) and planning to get a new stamping on my passport for revalidating the H1, so I would like to know If the error about the Date of Birth would be an issue. ALso my company is applying for an amendment and will give me the proof of application before I leave. But I would like to know if this is an issue for getting a H1b stamp again on my passport, since I will be sending the I129 to the consulate when I send my paper work for revalidation in India.
Are there any alternatives to get this done here, the important thing is that I am planning to go in November 2003.
I will take the proff of amendment application with me. I did not have any gaps in my entire stay in US, I always had jobs and was never in out of status or anything like that.
