Before filing your case, do a credential evaluation from a reputed company, see whether the evaluated degree matches the same in your labor certificate which you are goling to substitute. If yes, then it should not be a problem.
Also check how many years of experience is stated in the labor certification. In addition, you can also check whether the previous candidate's evaluation included the eductions only or eductions + experience.
Ask your lawyer to send you a copy of labor certification, if you go through it you will get exact information about the prev candidate, accordingly you can decide whether to go for it or not. Take some time to review and analyse the case, it will be good to be correct initially.
