Two different responses from BEC

Hello fellow members,

I need your expertise. I sent two “status check” emails in the span of two months and received two different responses

Response 1 Received on 7/5/2005
ETA Number: D-05133-XXXXX
Case Received Date: 05/13/2005
Status: RIR

Response 2 Received on 9/6/2005
ETA Number: D-04310-XXXXX
Case Received Date: 09/07/2004
Status: Closed

Could anyone of you please explain to me how it possible to have different data for the same alien? I am more worried about the second response as it says that the case is closed. I checked with my attorney and as per her the status is still active

This whole backlog elimination center is confusion center now to me. :mad:

Not sure what you are asking of me.
From the tracker it seems that your case would have indeed not made it to Regional.
Since your case came from SWA, it is "normal" that you have not received a 45-day letter.

So you have nothing "special" to worry about. Of course you can worry about how long you have been waiting but trust me you are not alone.

Send e-mails to Dallas and Philly h1b7yr@dal.dflc.us , h1b7yr@phi.dflc.us
include in your e-mail your first and last name how it says in application, your company name and include your information which you have published here.

Ask them that you need proof for your H1 extension

When you get screenshot from them please publish your information on the tracker (Dallas Backlog Elimination Center Tracking forum).

I have pretty much the same data with PD 11/2003 from MI.
I do not have 45 day letter either.

But at least I got from them Case Number and Case Status

45 day letter was answered in April 2005 (approximately). The following snapshot was obtained on Aug 25, 2005. Yet to receive the hard copy.

If anyone can throw light on NSC (Nebraska) related Questions / Issues to consider for those approaching certification / just certified. May be to Puhrince, Kanjoos, ....

1.) From a previous posting in this thread, it seems like separate filing of 140 is better than concurrent at NSC, especially if it is EB2 and it is unlikely to retrogress upto Jan 2003 or become unavailable. In such a case, how about filing CP.
2.) Apparently it would take 3 to 6 months for I-140 approval. This could be followed by a Attorney Certified CP in less than 2 months. Any pros / cons would be appreciated. This seems better than the uncertain AOS / I-485.
3.) Or is the I-140/485 close to attaining 6 months approval time, atleast for new filings. In such a case would you recommend concurrent filing..

Last but not the least, thanks a lot to Icarus and several others providing information. This is of immense intangible value, in the absence of information from the Govt. Please keep up the good work.

P.S.: If this posting has pushed anyone of the edge: I could not find a better thread to post issues related to the bridging period between Labor and 140/485. Neverthless, I thought the postings to these issues would be useful to several others. If you disagree, please excuse.

In order to get faster results, is it better to file I-140 and I-485 concurrently or seperately?

:rolleyes: HI. I finally got my screen shot. Cases Satus: Certified. Priority Date: Jan 24/2003. It took me around 4 e-mails. I guess now it's only a matter of waiting to get it by mail. After all these years this is a releif!

First time it took a week. The second time I got the reply in less than 5 mins.

Just got info from my lawyers that my LC has been approved.

Filed in Dallas, TX
PD - 05/03/2002
Transmittal to Regional - 11/14/2002
Case # - D-04275-10XXX
Received 45 day letter on Jan 7 '05 and responded on Feb 02'05

Got Labor Approval today.

Guys,
I got labor approval today. My Lawyer received hard copy. My case is EB3/RIR. My Q is will there be any advantage for me if I file I-140 before the 30th of this month? OR it doesn't matter since my case is EB3?
Any info will be greatly appreciated.
