I won't recommend this

I won't recommend calling certifying officer unless it is emergency. We will end up having troubles for ourselves like we did for 7th extension letter. Now they don't give status of 7th year email.

What abt RIR cases never made to regional??

Hi s_chicago,

what abt RIR cases which never made to regional, and what is RFE? Do DBEC process TR regional cases first and then go for RIR state cases?

You are right. # of cases from my post is shared between the 2 BECs.
So all the RIR regional cases with no RFE should be cleared by mid Feb.
Here is the # of cases from Mar to Sep' 04. About half of them went to dBEC.

45 Day letter received on 8/15/2005, replied on the same day.

My PD is 11/03 and RD is 08/04 and no queries at state level except employers existence check along with 45D letter but so far I have not receieved the approval. I called up my lawyer several times but he says he has not got my approval, I am frustrated..

Experts: do you think any problem with my case becoz when my attorney sent status check for my case they got the reply that "currently awaiting further review by a Backlog Elimination Center analyst" I don't what it means? Do u think it is a problematic case?

It seems that everybody who talks in the forums about LC approved filled under RIR. I wonder if my lawyer was the only stupid one that filled my case under traditional.
Does anybody know where is the Tradional queue, more or less, on the Dallas Backlog center?
It seems the RIR moved to 2004 already.

My employer received NOTICE OF CASE CLOSURE letter

Hi Friends,

My employer received a letter from Employment and Training Administration (NOTICE OF CASE CLOSURE) last week.
He received 45 day letter in March and my attorny replied on 03/29/2005 but still he got the above letter.
My attorny sent me an email saying that
"We are aware of this and have contacted the DOL to get the case reinstated. Both the Philadelphia and Dallas backlog centers has been sending out these cancellation notices on cases that the 45 day letter has already been sent in. Clearly something wrong with their system. We will let you know as soon as the case is reinstated."

I was reading the 45day letter and it says
"If the response is UNTIMELY or INCOMPLETE your case will be CLOSED.If the case is closed ,you may at any time thereafter resubmit the alien labor certification as a new application with new submit date"

I am really worried about that, what is my situation ?
Completed 6 year in Nov 2005 and applied for 7th yr extension and working.
Am I going to loose my priority date ?
Can I get 7th yr extension ?
When can I get my labor certification ?

Jun 14 2004 is priority date
Aug 31 2004 moved to Reg
Received 45 days letter in last week of March
Replied to 45 days letter on March 29th 2005
Received NOTICE OF CASE CLOSURE on last week.
State MN

Me too.....I think people are getting crazy day by day. If really there is an option (people calling certifying officers etc) definitely BEC will let everyone know and publish in their bulletins.

Here is the copy right notice enclosed in the response received for 7th year extention from BEC.

"This message (including any attachments) contains confidential information intended for a specific individual and purpose, and is protected by law. If you are not the intended recipient, you should delete this message and are hereby notified that any disclosure, copying, or distribution of this message, or the taking of any action based on it, is strictly prohibited."

Sharing the status is OK, but i dont think people are doing right thing by distributing certifying officer name and his contact details in a public forum like this. Please think twice before doing these kind of activities.

I also thought that my lawyer made the same mistake, but according to him I had more chance of getting an approval with regular application but here is my info:

Hi,
Dont get tensed. I know it will be hard to know this kind of information after a long struggle. But it can be easily solved by your lawyer / HR team. Talk to your lawyer first, your case can be reopened without any problem. May be it will take some time but its sure that you can always reopen the closed case. If you go through the history of this forum you might find many people was in the same boat as you and every one posted back with positve response saying their case was opened. So dont get tensed, relaxed and things will fall into lap. All the best.

Get it reopend by your lawyers, i was in the same situation and they reopend the case. It got certified in 3 months.

For regional cases, it is easy for BECs to approve an LC. But for cases that were transferred from state, need verification of 'recruitment effort', ‘minimum wages’ etc and takes longer and need extra knowledge for a certifying officer.
Logically, I think, after completion of RIR, regional cases, dBEC will start processing all cases in FIFO regardless of RIR or TR.

a. Since my LC PD is Dec 2003, can I get 7th year H1B exten without any issues?

OR

b. Do I need to get the I-140 approval before June 2006?

yes you can get 7th year extension since your PD is in 2003

Just put your state/RIR or NON RIR/ EB2 or EB3

This will help for all otheres who is having pending labour.

I am tired and frustrated...please say something wise to help me hang on

I have been waiting for my LC. folks who filed a month before me have been cleared several months ago. Friends from countries like Iran got their LC in months through PERM. Dont get me wrong - I grateful that i have a steady job and that i am in a company where they are willing to sponsor etc. But, i am just tired of not having a damn choice. The choice to settle down and say, yes, I will be here for the next 20 yrs or whatever.

Please...i thought i had patience. I dont. My lawyers cant help in anyway. I have requested for screen shot for 7th yr ext...nothing.

For those of you who have been in backlog longer than me, please, say something wise...something that will help me just be grateful that i have this opportunity to make a life here...so many of our friends would die for a chance to come here and have what we have.
