I don't think you can change the EB category for a pending LC. However you can change a 'Traditional Recruitment' case to 'RIR' case. Please read this link.

senator !!

I was wondering, if any one got help from senator to get his long pending labor certified. I am planning to do as my labor is pending for 41/2 years. Would any one suggest me is it the right idea or not? Also any purticular format i need to follow to approch senator.

Please help, if any one knows about this.

Fianlly after 5 and a half years my May 29, 2001 labor is certified!
Mine was a remanded case and it was certified without any ads, I did not ask for conversion and did not ask DOL to treat it as RIR either.
I did write a lot of letters to DOL and Senators and Congresswoman but that was long time back and I don't think that helped much.
I really really wish everyone who is still stuck best of luck, especially the remanded cases, there is no one else who can understand this pain more.
I haven't received the papers yet, just checked it online today.
Once i get the papers I will let you know.
Gosh, this is unbelievable, I hope next stages are quick, hope to start my new life soon.

Still no 45 day letters

After 3 years of waiting, Still no 45 day letter received !!! and online status is showing Data Review. Really frustraing and wondering what's going on. Any input?

I can totally relate to that my friend. Remember to think about these days when you have the actual GC and perhaps we could together do something that would make lives of others easier.

BTW - I checked mine and it shows "CERTIFIED" as well.

Congratulations to 2001 approvals! I can very well understand your pains.

After a long time I can see some 2001 cases being approved. My PD is also May 29, 2001. Case no. is D-05131-xxxxx. I hope to hear something soon.

How could you file 485/EAD/AP when you have PD as MAY 2004 under EB2 category ? Pls respond..

Forget asking anyone.I found out the case number myself. After 1 month of seeing online case status as certified then my lawyer said we got your approval letter. The lawyers usually do not give.Maybe 75% of the people here have found out the case number themselves. I did and most of them posted they did. Ask for a screenshot of the case u will know your case number. after that u can see the status online.

My case was also D-04320-xxxx

I spoke to my employer and lawyer, my employer agreed to sign a letter to a various officials.

We got most interest and cooperation from our congressman, and corresponded with him for over 9 months. His staff contacted Dallas BEC and we received copies of their replies. Initially they were the standard, "case is being processed". However over a period of time, and including evidence such as tracker data from this forum, we demonstrated that FIFO wasn't working and my employer complained that he need a swift decision for business stability etc.

My pd is 25 Nov 02. The ETA-750 was approved 30 Aug 06.

My employer opted for premium processing of i-140

I am now waiting for visas to become available.

Congratulations - a long wait indeed!! but the good thing is, no matter where are you from, you are close to concurrent filing now.
 
At long last!

After 5 and a 1/2 years, my labor cert was finally approved. My PD is July 2001 and was initally applied through RIR and was remanded to regular and was now approved without readvertisement or anything! So, there is hope my friends! 45-day letter was received on December 5, 06 and the web site was showing the case as certified on January 8th, 07.

Now, for the tracker, which state was your LC filed from? Did your case made it to the regional DOL?

My LC was filed in Texas and it had made it to State DOL and they had denied the RIR and sent it back to regular processing. I don't think that it is of any use to get any senator or congressman to write any letters to hasten the process.
 
Labor Substitution and Perm ium

Hi,

My husband employer is opting for labor sibstitution because our Labor has NOF ,which we recieve very late actullay close to reply date .Now we asked the lawyer to file for I-40 permium , and he was told its not possible ,is that true for the labor substitution , there is no permium for I-40 . Advises are appreciated please reply.
