Call from BRC

This week my lawyer received a call from the Certifying officer asking for some updated documents.

This is dissapointing in one sense but the brighter side is that they are actually have my case at the CO's desk. We had submitted those documents before but it looks like they don't have those.

45-day letter not received!!! Concerned!!!

Hello,

My case details are as follows:
RIR/EB3
PD (Nebraska) = Aug 04
RD (Chicago) = Aug 04
Dallas BPC Case # = D05006-XXXXX (I presume the case was entered on 5th Jan)
45-day leter: not yet received

Should I be concerned that my attorney or my employer has yet not received the 45-day letter!!!

In one of the earlier posts, Icarus had mentioned that the data-entry person enters data in an abbreviated form, moves on to the next cases, comes back to the original application and completes it and generates a 45-day letter. Is there any reason that the data entry person would not complete the application data entry in one sitting? What is the basis or the factors on which he decides that he needs to complete the data entry of an application at a later stage. I have seen many cases which have the case #s which have been entered beyond my date and have received the 45-day letters way back. Any insights?

To fellow sufferers with PD date before May, 2002, 45-day letter and no approval.
Do you think we are going to get a lot of NOFs, transfers to TRs soon? Did anybody hear anything from their attorneys? Lets pull all knowledge together.. and lets start tracking RFEs in PD tracker(maybe a separate column?)

My attorney says that Dallas BEC processes cases with no obvious trend of PDs and its too early to worry.

I can tell you my experience, My info was fed in system, it took them approx. 20 days to make from T-05011 to D-05011 & another 30 days to send 45 day letter.

I am concerned that my case was first entered into the BPC system on 6th January 2005. It is 6 months now. I am not sure why they have not gotten around to complete my application data entry and generate the 45 day letter.

Any insights?

My attorney said the same thing as your's. He says that the approvals have started to trickle in and will contact me if hears anything from the BPC. I feel the delay is at the CO table where he/she is making sure everything is right before approval. Hopefully there won't be any NOF's or RFE's and everyone's gets approved.
I'm also waiting for over 3 years and have started my 6th yr of H-1. It is very frustrating!!! :(

Received the Labor Approval yesterday from Dallas Center.

LC filed Category: EB-3, RIR
LC filed State: OH
LC PD: Jan 2003
45 days letter: Yes
45 days letter Send Date: March/2005


So seems like even the 2003 cases are being approved......

Just want to make sure that this is not a special handling case ?
If not then it must be FIFO by BEC 45 day letters:)

Can u post ETA-D04???- first 4 digits of ETA numbers.

It is not a SPECIAL HANDLING CASE. The ETA Case number is D-05006
 
If we wait forever..

Us people from April/May/June 2002 who have obviously been passed over by the queue...we need to do something. If we just sit here then come August all the Visa numbers will be exhausted and all the people in the queue after us will be sitting in the 485 queue...

Mnhrdc, Raydhan, what do you propose? :mad:

what are you worried about?

ZB,

you're EB2, and I don't think EB2 will retrogress such back as 2002. Just check the visa buletin history.

You guys are already lucky enough to be in Dallas and your case be processed. Probably within several weeks the approval will come...

Look at Philly, stuck in 2001 and seems still at least 6 month, even a year just to reach May 2002 CA cases...

Hi ZB,

2 weeks back my Lawer received lot of approvals from Dallas BEC starting PD 2001 to Aug' 2002. Mine was with PD June 2002 TX /RIR/EB2 case. No Approval at.... Regarding 45 letter I got it on Dec' 17 2004 and we replied on 20 Dec 2004.

Icarus can you please help us.

If at all if we have to worry, we should worry about FIFO at dallas BEC and not definetly about I-485 because when Visa dates retrogress, It is allready proven that it is allways by FIFO by PD and not by application filed date.

I am puzzled, wondering and dumb stuck about approvals being recieved in LIFO order by PD and also 45day letters ETA-nos. However feel good about that one case less allways gets us closed to CO in the long Q.

I think nobody has been passed over by the queue as per Icarus. Here is his post.

Absolute stupidity...

I think, this is absolute stupidity. Degrading humans. I love America, and its culture. Bush has done everything that is Un-American, Un-Amethical(Un-ethical). Hope these lawmakers find some sanity back and behave in good manner and treat everyone compassionately.
