If a person applying for 140/485 lives in california,but is company is headquartered in the east coast and company files for the same in VSC is that a problem? Wherever Job location is asked "to be determined" is what the company has put in.

Since Labor approval is from VSC area and company headquarters is there will it be adjudicated there or transferred to CSC?

99.99% of the cases are processed only at the geographical location of where your GC Sponsoring company resides. In your case its Vermont, so I dont think that it should be a problem of your file getting processed in Vermont, even though you still not be able to avail the PERM process.

First of all - I am not aware if you can put "to be determined" as job location. Secondly application of LC specifies your intent for future employment location. Thirdly 140 has to be applied in same jurisdiction area as that of LC.

Apply from VSC - you do not have option. Also going back to your question - it is not a problem.

BTW is their clear indication of applicability of Ohata memo to catch-up concurrently filed case where 140 was filed in March 2004 (before memo applicability) and 485 filed in May (after Ohata memo in effect)?

Will it be considered as case for concurrent adjudication as per memo or will it follow the old scheme of things?

FO memo is like Beagle 2 just that in this case nobody knows what it means where beagle 2 is saying hari om in the outer space and not interested in contacting humans.. so much for the british tech :D
