CSPA for DV 2014

My CN is AS17xxx.I am neither from Iran nor from Nepal.My eldest son is a derivative of mine.His date of birth is on the 05.11.1992.
There is only September visa bulletin is to be released by KCC.So if I get a chance to face for the interview,will my son be protected under CSPA?
Is there a possibility to request for an advanced interview,so that my son also will have a chance to face for the interview?Is there any action to be taken by me at this moment on behalf of my son?

There's no action to be taken on your part for as long as your son is considered under 21 according to CSPA calculation as at Sept 1, 2014 regardless of whatever date in Sept your interview may take place (assuming your CN goes current).

Could you clarify that date of birth. Is is May 11, 1992 or November 5, 1992?
 
The date of birth is November 5,1992

My bad! Please disregard my earlier posts. I believe your son has aged out and he's not protected by CSPA. Sorry!

p.s. my incorrect calculation had nothing to do with wether his DOB was 11/05/1992 or 05/11/1992 though.
 
I agree with Mom - and I was just trying to get the dates clear in my head.

Sadly your son aged out on June 5. So - if you had gone current in June (any time in June) it would have been ok, but once June ends he is considered aged out. You cannot do anything about that (like asking for an interview before your number is current).

Like I said. Nothing you can do. He is only protected as part of an immigration process that you cannot start yet because you are not current.

If he doesn't get a chance to get DV visa this time(if my number becomes current),what am I supposed to do,in order to obtain an immigrant visa for him with the minimum time period?It is disheartening to leave a child behind & migrate with other family members.
Do they only take into account the time period for visa processing for CSPA?But the time period from May to October is also wasted for a derivative child who will be becoming 21 years of age during that period. Isn't it ?

The CSPA takes the period of time between the DV entry (October 2, 2012) and the earliest notification of the selection for further processing (May 1, 2013). That difference (212 days) is added on to the childs age as an allowance BUT the case has to go current within that time.

Your only choice, if you decide to become an LPR is to sponsor your son. However, that can take a long time (currently F2B are backed up to 2007). So it is likely that you could become a citizen before your son is able to get a Green Card. You could also consider what non family based immigration routes are open to your son (i.e. education, work sponsorship and so on).

Would it be possible to apply for a tourist visa for my son & get it at the same time of traveling with us,as we all hope to apply for re-entry permit & return back in two years?
What is your advice? please reply.

You need a reason to apply for a re-entry permit. I don't know if they would accept this as a valid reason especially as your son will not be one of the DV beneficiaries (and even if he was it would only be a valid reason for him, not the rest of the family). It will probably take a month or two before you can leave if you are applying for re-entry permit as you need to do biographics.

You could apply for a tourist visa for your son but to be honest I think he would be highly unlikely to get it under the circumstances. If the rest of the family is emigrating - as you will be assumed to do with an immigrant visa - the obviously conclusion a consulate would draw is that the son will not go back so you would need some very strong evidence of ties to the home country for him.

Many predictions say your number has a chance still. In 3 weeks you will find out for sure.

Thank you very much for replying.I am an employee in the state sector.So, I am planning to go on leave(maximum of 2 months) if visa becomes available.If I don't return back,I will loose every benefit of retirement after working for so many long years in the state sector in my country.We are leaving behind everything we own in our motherland with the purpose of returning back to sort out every thing, as it needs time.Do you think that these facts are not enough to convince the CO that we are coming back after reporting in U.S?I have another younger derivative child who will be sitting for the university entrance exam next year.Due to all these factors it is not possible to immigrate straight away even if we get visas.

Please explain me what do you mean by bio-graphics?

When you post a question, you may need to wait a couple of hours or days sometimes, depending on when those capable of providing an answer are online and able to get to it. Don't make assumptions as to why it hasn't been answered.

Regarding the re-entry permit, it's not always automatically approved when one applies, you will need to provide a valid and acceptable reason in order for it to be approved. Like Susie already responded, getting it approved on the premise of wanting to be in your country while your son finishes college is most unlikely. And I hope you're aware of the cost of each application by the way.

The US government realize that it's not easy to simply pack up ones bags and migrate to another country upon being issued with a visa and they've made allowance for people to go back and tie up loose ends.

You're only required to initially enter the US before the expiration of your visa to activate your LPR status and possibly establish ties indicating you're not abandoning the status, following which you can return home for up-to one year without needing a reentry permit to tie up loose ends. It's only if people are staying out for one year and above that they need to apply for the permit.

Getting the visa does not make you a LPR yet until you enter the US which is when that status gets activated, so you can't even entertain the thought of applying for the permit as at the time of getting the visa. Secondly, the re entry permit can only be applied for from the US. When you send in the application from the US, you will need to wait to receive first a notification that the application has been received and second, a letter asking you to go do biometric (this is where they will take your picture and finger prints - and that's what Susie was trying to state when she mistakenly typed 'biographic' in her earlier response). You can then leave the US provided you requested for the reentry permit to be sent to your US home embassy when the application was originally submitted otherwise you will have to stay back in the US and wait to receive it before you can travel out.

The more you say, the more it seems like you shouldn't be emigrating at this time....
