CSC-I140 RFE cases

Hi microdev1,

Message says that you will have a written decision.
What does it mean?
They are going to send written decision rather than email.
How was your case?

Written decision means that they will send RFE response decision by snail mail.
You will not receive decision but ur attorney will.
But if they approve ur case, you will obviously receive an email if you have registered with USCIS.
About my case, it was Substitute labor, EB3. Had RFE for "ability to pay" and they also needed education document originals to verify education credentials.
 
Of course I had exactly the same RFE (education, ability to pay) for my EB-2 application which I responded to on 12/21/04 and I am still waiting. Pathetic :mad:

what is snail mail?

If my case is approved, they will send an approval by snail mail and email at the same time or snail mail could be early?

stevphel, did u submit original education documents?
I did. I sent as many originals I could to prove my education credentials, sort of overloaded them.
 
I-140 RFE (Need employer's signature)

Hi,

I got an RFE for my I-140 application.
"The RFE is due to the new CSC policy that the employer must sign all forms (the attorney is no longer allowed to sign for the employer). ".

Has anyone heard of this one earlier ?

I cant understand how my attorney could make this mistake.
Sometimes, it makes me wonder whether they are doing their best to delay the whole approval process.

Microdev,

I sent them copies of my three degree transcripts with US equivalency statements. Why do you think non-originals would slow things up when they explicitly say not to send originals? :)

Well, in my case, they asked for originals. May be in ur case, they didn't

I replied I140 on MACH 16, 05 and am still waiting.
Anybody in the same situation.
By the way, the people on USCIS emergency line are adjustification officers or just operators?

how long after 140 RFE?

Got RFE on 140 for experience letters, educational docs and company's financial docs. Responded on Mar 31.

As your case is EB3, expect the RFE to ask for reference letters from your ex-employers (most likely 2 years of experience in the SAME area as the original Labor certification states) I was told by my lawyer to get the letters & those MUST state the positions held were full time positions & they were 40 hours/week type (as these were mentioned in my labor appl) Plus they ask for the educational diplomas and most likely your company's financial documents (Business license, Wage Report for last 3 quarters, Tax documents etc)

I140/485: RD: 6/4/04

I hope I485 approval follows.

There was no LUD since LUD right after they receive RFE reply.

Message is follows after approval.

This case has been approved. On April 4, 2005, an approval notice was mailed. If 14 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please call the National Customer Service Center at (800) 375-5283.
