BTW, I just sent an email to find out about the status of my application since I becamse current ! Will know the extent of rape from the reply and keep you guys posted

Help me understand the email response

Hello folks,
I received a reply from CSC-XII.485@dhs.gov, which is as follows...
"Your case cannot resume processing at this time because according to
the
Dept. of State's visa bulletin for April 2006, 2nd Preference India's
cut-off date is 07/01/2002 or earlier. Accordingly, the priority date
in this case is 02/06/2003. Therefore, a visa is not currently
available to you. We will continue to monitor the visa bulletin on a
monthly basis and will complete the adjudication of your case when a
visa becomes available. Thank you."

Can this reponse be interpreted as completion of name check/ background check?

Not sure about your question's answer, but I have another question - how long did it take for you to get a response?

I sent an email on Apr 1, the date my PD became current, and I am not sure how long I should wait to hear from someone.

It took 3 weeks.
From what I saw in this forum, it takes at least 3 weeks for a response.

Don't worry u'll be fine.

That's good to know. Will wait for end of April. My lawyer said that they will also initiate an enquiry for me after 30 days of date becoming current. So end of April it is!

My PD is also April 2002 EB2, I sent an enquiry on march 19, still waiting for response... will post once I receive.
 
Waiting for Spouse to join my 485

Hi Team,

I applied for 485 in September 22, 2005 and I got married in Feb 2006 and now my wife is in India. She has an H4 visa appointment in 2nd week of April and If everything goes well, she will be in US in 3rd week of April. As you guys know I should not get 485 approvals before she enters in to US. Here my question is, what are the chances of getting my 485 approval? I am tensed about my situation, please advise me.


Here are my details:

I-485 Priority Date: Feb 2002
I-485 Received Date: September 28, 2005
I-140 Approved: June 2, 2005
EAD approved: November 15, 2005
AP approved: November 8, 2005

Please through some light on my case.

Hi,

Does anyone know how long it is going to take to adjudicate 485 after FP.

I received an email from USCIS today morning stating,

"FBI fingerprints have expired so we've scheduled you for the fingerprint appointment at the USCIS xxx office on 04/14/2006. Once you've completed this appointment, these cases will resume processing."

My PD is current, and my Name check is cleared according to an earlier email from Mr. Williams.

I contacted with attorney, the attorney is saying, my wife need to be in US to file for FTJ. Do you know, is there any way I can add my wife to my 485 processing?

Like Shaaka, me and my wife also had our FP done in Nov'05. But there has been no LUD changes on our 485.

I wrote an email and got the following reply from Officer Cruz :

Unfortunately, the principal applicant's background security check has
not yet cleared by the FBI as of this date. We regret to inform you
that until the result is received the USCIS must suspend further
processing on this case as well as the dependents. Thank you for your
continued patience with this process.

Does anybody know what it means. I am not sure if Ms Cruz is saying that my case is in Namecheck or if she is saying that our FP results have not been received from the FBI.

Any guesses ?

Hey GP,

Are you sure about the fact that CSC has not moved most I-485s whose I-140s are already approved. MY lawyer just confirmed that all pending 485s are going to TSC and all new ones to NSC!! Not that she is supposed to be a "know all" but she IS the lawyer!

Gurus...any Idea?

I just got the email updates saying that my case also being transfer to LA local office for an interview. I am EB2 RIR. Same company in the past 5 yrs, stable job, well paid. It's kind of weird for a EB case being called interview, right? The only reason I can think of triggling this may be because I got married just before filing 1-140/485 and brought my spouse together to the case .
Anyboday has the same situation or heard about similar case? Any help or share is very appreciated. I am not worried about the interview, but wondering how long it would take for them to schedule an interview and how long after the interview we can get the final answer. Is there anyway we can reach the local office?

not yet cleared by the FBI as of this date. We regret to inform you
that until the result is received the USCIS must suspend further
processing on these cases. Thank you for your continued patience with
this process. You can check back with us after 60 days to see if the
checks have cleared.
