AVM did not change until Mid May 2002, then changed to saying "FP received and case resumed".

06/24/2002, RFE reached my lawyer asking for 4 recent pay stub, W-2 of year 2000 and 2001, employment verification letter.
06/25/2002, RFE responded.

Checked AVM regularly. AVM never mentioned RFE. AVM only changed today saying the case has been approved.

However my wife's case (I-485 filed at the same time as mine and as my dependent) AVM still saying "FP received and case resumed". Any advice from any guru? Anybody who have expereinced the same situation?

I am still waiting for the approval notice. Will post later.

Hi, I visited this forum for a long time and finally it's time to share my great news:

Both my husband and my 485 case was approved on 8/13/02 according to the AVM. I have called INS on 8/14 to confirm our approval.

PD: I don't know what's the PD. We started our application at the end of Nov, 2000. Labor only took 3 weeks while I-140 took about 8 months (with RFE after 4 months) after we filed it in Feb, 2001.
RD: 11/13/01
ND: 11/23/01
AP: 01/09/02
EAD: March, 2002
FP: 4/09/02 (I took a 2nd FP on 5/09/02)
Approve Date: 8/13/02

INS officer told me today that our approval notices were sent on 8/13/02, and we need to bring two photographs when we go to stamp our passports.

I kept checking AVM every 3 or 4 days, and the message was always "999 days" until yesterday. When I heard the work"this case has been approved on August 13th, 2002", I just couldn't believe my ear. My husband said I must have entered the wrong case number.

I got a lot of useful information from this forum. Thank you so much. Wish your lucky day will come soon!

I know it was a long journy. My wife's case was approved on
Jun 24 2002(Although I am the principal applicant). I forced my
Lawyer for Fax inqueries after my wifes AOS approved. The case
was approved after 3 fax inqueries.

Folks with WAC-01-***** series a small suggestation go for
fax inquries it definitely helps.

PCEE for the tracking information.

I used to visit this site every day(It became part of my life).

I wish all the best for people still waiting for their approval
specially to those who applied before oct 2001.

My struggle started in June 98 and would end very soon (waiting for approval letter). By now I'm already tired of waiting and just feel glad that it will be over soon.

My company applied in 98 with EB3 but its I140 got RFE as my degree was Mechanical and Labor cert specified Comp, EE. Lawyers sent clarifications but INS turned it down and forwarded it to AAICU, an organization that takes about 2 years pass its verdict. This was first of its kind in my company as others with even Metallurgical eng. had gotten through. It felt even worse as EB3 was current at that time and if my I140 had been approved.....

My lawyer filed another EB3 in 1999.

In the year 2000 I got my company to file EB2 using progressive experience criteria (BS +5yrs) but got RFE on its I140 and lawyer didn't even care to reply RFE.

In year 2001 my wife couldn't get residency in any hospital as we didn't had EAD or Green Card.

In 2001 July the I140 of 2nd EB3 got approoved and a few days later I140 of 1st EB3 also got approved for CP. Didn't pursue CP because of job market and applied 485 with
RD=Aug 6,2001 ND=Sept 13,2001
Lawyers had applied 485 using 2nd EB3 labor cert and I140 and in Sept sent INS 1st I140 to reclaim the priority date of 98.
iEAD= Nov 9th, FP=Feb 2nd
Officially laid off in March. Got RFE on March end for
1. Salary slips , letter....
2. Copy of 1st labor cert

My wife got RFE for the proof that she was legally staying here during her stay on F1. This after providing INS with all her I20, H4 visa and I-94 with date of entry etc.

My company lawyer gave me a lot of attitude about my asking questions about RFE filing and documents I had to furnish and also told the fee to be $325/hr. Thank god I got rid of her and got another more approachable one who filed it for just $250.00 After six months of no salary I got a job filed my RFE in June received by INS on June 18th. It would have been 2 months by this weekend and I was thinking of asking lawyer to file inquiry and also sending a letter to Congressman as suggested by few folks on this board.

I moved from South bay to Walnut Creek 2 weeks back and hope I'll get my letters mailed /forwarded to new address. Does anybody know where I'll have to go for stamping...San Jose or San Francisco.

This board has been very supportive and informative. I got more info from this board than ever from my previous lawyers. Thanks PCEE and others for all your selfless help. You guys are great.

All,

Just called the CSC line and punched in the nos. as usual (got to the point where i could do it blind!!!) and expected the usual FP mesage... but was surprised! Approved!

EB2/India/OR

AVM changed to approved on 08/14/2002

Both cases approved and all the dates are similar for both cases.

Finally, my case has been approved.

It's been a journey spanning approx 6 yrs. I had filed my Labor in Jan 1997 with a company which finally got dissolved in 1998. had to re-apply in June 1999 with another company. Had many issues and RFE's surrounding my H-1 extension beyond 6 yrs which left a bitter experience with INS. Had RFE on I-140, Advance parole and the latest on I-485 as well. Eventually looks like INS got fed up with my case and decided to approve it. And they didn't bother to update my AVM with the approval; instead i got it in the mail today, approved on Aug 12. Nevertheless, it's a big cause for celebration for us.
