CP Gurus ...Pls Help !!! Going for CP but confused about spouse\'s status ...

My spouse got a H1 approved in June\'01 but the company waited for 2.5 months and then decided not to hire due to the economy. So we applied for change of status to H4. Then after one week of submitting 539, they decided to hire. So we sent a withdrawal letter to the INS and even talked to 3 different IIO\'s (on 3 diff occasions), all of whom said that 539 is withdrawn. So the employment formally began in Oct\'01.

Will this cause any problems in CP? Spouse has been working ever since for the employer of the same H1. Is it out of status???

Pls Help !!
 
Looks Like she has been in Good status all along

Consulate just cares about applicants beein in good status and in US on a valid visa...not staying date mentioned on I-94(small card attached to apssport)

1. They do care about expired I-94\'s, but in your case that is not so, because the H1 would have come with a new I-94.
2. Also your wife should be OK, as even though she received a H1, it never came to effect, till she started working and got paid, that is what would be my understanding. As for ex. if a person is on H1 and he applys for 3 more H1\'s and never joins those companies, still his old H1 is the one he is using. So dont worry and just go for CP.
