dear all,

I'm finishing up my visa application for a green card by marriage, coming from a J1 and would kindly ask you to look at my cover letter to make sure I didn't forget anything important and if it turns out everything is correct, somebody else could use it as their cover letter.

regards.

You have not addressed whether INA 212(e) applies or not and if it does or if it has been waived.

Is there a reason for not including the I-131?

regards: INA 212(e), I have never heard of this one, what does this refer to?

I-131: good idea to apply for it too, but I don't know my travel dates at this point in time. So I thought to skip it and apply for it once I know when I will travel.

thanks

correction: INA-212(e) does not apply and is stated on the copies of the Visa's I submit and the DS-2019 copy I submit. So doesn't this cover it?

The I-131 (Advance Parole) takes 2-3 months to be approved, so if you wait until you know your travel plans it might be too late. They're not going to bind you to the date you write; just write something and send it in. If you don't travel at all, or travel on a different date, you're not going to be penalized.

However, if you overstayed by 180+ days you should not apply for the AP, as it would be useless even if approved.

USCIS does not care about any travel plans. File the I-131 w/I-765 so they can issue a Combo card.
