Converting E2 to H1B

Hello,

I currently work in the US for a UK owned company with a US office (hence qualifying for my E2 visa). I've been here for 2 years now, and want to stay. I have been offered a position in a US owned and based company and would like to join them. However, my E2 viasa is tied to my current employer. It could be transfered to a new employer, but only if the new employer was UK owned (which it's not).

Is it possible to switch the E2 visa to an H1B visa to enable to take the new job? Or do I have to wait for the applications to open on April 1st? Even then, if I applied and was successful, I couldn't join the new company until October 1st, and they can't wait until then.

Any help would be greatly appreciated.

There is no way to get H1 at this moment. You need to wait for April to file H1 petition and need to wait for Oct 1 to start working.

You may want to try a J-1 visa as a trainee at the new company until October when you can begin work on your H-1B. Keep in mind though, you must wait at least 60 days before applying for the H-1B visa once you've entered the country (or changed status into) the J-1 visa. Also beware of H-1B quotas which are being met quicker every year. (info@thevisaexpert.com)
