Conversion from F2B to F3?

Hi,

My mother filed 1-130 for me under F2B in 2008 when she was a permanent resident. Since then, she has been naturalized and is a citizen now. I am still single and living in US on work visa. My question is if I get married, would my case be converted to F3 and the priority date remain the same from the F2B application? The priority date is current under F3 category as of september visa bulletin and not for F2B.Also, would be wife will also get green card if it is allowed to keep priority date same and convert from F2B to F3? I am India born.

Yes, you’d retain the priority date from the original petition. (By the way, if your mother has notified uscis of her status change you may have been changed to F1 unless you elected to retain F2B.) Yes, your future wife would be added as a derivative and get a visa at the same time as you.
i don’t see any F3 priority dates current when F2B is not? For India F2B is 22 Sep 2015 and F3 is 22 Nov 2008 in the Sept VB. If your F2B was filed in 2008 you should have gotten a green card some years back already? Was that a typo?

My mother applied in 2008. So the priority date is current for and not current as August 21. Also, when I get married Can i also apply for her green card too?
 
I meant if i get converted to F3, then as of september 2021 visa bulletin, nOV 2018 priority date is currently current when my I 130 was filed.
 
But the visa bulletin is not anywhere near current for F3 for a 2018 priority date, not sure what you are looking at. You are probably a few years away from an F2B-based green card and about a decade away from an F3-based one.
 
One question. Does my mom need to inform USCIS that i still want to be considered F2B or when the priority dates comes, then i inform them. In that case me or my mom send letter to USCIS because i have never hired in my whole life and always worked...need your advise....

Your mother is the petitioner. She needs to tell them that she is a citizen, and whether you want to retain F2B or switch to F1 (Google F2B retention for sample letters). You can decide closer to the time when you see how the priority dates are moving.
You only get the option to choose between F2B and F1. If you get married you do not get the option and will switch to F3.

It depends.
My case my mom kept file in 2011 on Green card. Then after certain years she became Citizen.
So we updated our file from Green Card to Citizen Unmarried son.

But then Green Card Unmarried Son Category was going very Fast. I did extreme researche, if I can retain the category which was originally filled.
I did called and email , and finally got clue, need to give written Paper that you want to retain file to Green card, which I went personally to US embassy in India, Delhi. My request was accepted, they did converted or I will say Reverted my category to Green Card unmarried son, and as the priority date reatin original file kept 2011, and I got the nvc processing after month as my file kept and current date under GC was same.


Note- You can change update From GC to Citizen category. Also you can retained from Citizen to GC. The petition date will remain same the original file kept. Hope this can be helpful to some one.
