Continuous Residence

Dear all fellow forum members:

I am unclear about the Continuous Residence on N400 which said a PR holder can not leave the US for for a trip that last 6 months or more.
My story is: Physical Present in the US is more than 30 months for the last 5 years and has never left for a trip that last 6 months or more.

But, in 2008 alone I had many shorter trips that all add up to more than 6 months.
1st trip: 2 months
2nd trip: 3 months
3rd trip: 2 months

All are 7 months within the same year(2008).
My question is whether I still maintaining a Continuous Residence or did I break it?

If they were back to back, you may have to prove that you did not intend to break continuous residency during the time.
 
You would show evidence such as purpose of trips, tax receipt for 2008, utility bills, rental/mortage agreement.. etc. There's no certainty that you will be asked about it at interview, but you should be ready just in case.

Need Help:

I am almost ready to apply for Citizenship August 09. I have been out of US with the N470 approved.
In 2007 I flew each month to Europe and back since I negotiate contracts for a big US company.
In 2008 they asked me to stay in assignment there and got approved for N470, I fly every 3 months back to US.

I have more than 30months continues and also have my salary paid in US in US bank. As well I pay US tax as Resident and State taxes.

I have a car which I paid regularly till last month after payments were done. I continue to us and Pay US Credit/Debit Cards.

I intend to return after my assignment is over but not sure when this will be.

ANY Advice how are my chances on receiving Citizenship.

You may be asked to provide the evidence eventhough none of your trips have individually broken continuous residency requirement. Back to back trips can be seen as a sign that you intended to break continuous residency, hence the possibility they may ask for you to provide the evidence.

The N-470 allows you to preserve your continuous residency requirement while outside the country.They might question your trips in 2007 before you got the N-470, but other than that I don't see any issues.

Physical presence of 30 months in US must be meet even if you have the N-470 approved please that in mind when you apply. So if you are short of 30 months make sure you apply after 30 months physical presence in US.
