I was told the same about my NC at Infopass at the end of December so I am reasonably sure about it now. I didn't know about my wife's case before so this was a really good news. They also told me that our cases are with an officer which really got me excited but they cautioned me that it may take more then few weeks I had in my mind. They mentioned couple of months (!?). Apparently cases are probalby assigned to officers in batches. I think somebody (lab_???)mentioned something about it yesterday ...

Well my cas was aasigned to an office on 12-09-06 and approved on 02-23-07 just ti give you an idea how long it can take

Couple of days back, I also read a court opinion dated 2/2/07 out of NJ district that basically says the same thing. The particular applicant was waiting to be naturalized and his case had been pending for over 3 years. Judge basically wrote an opinion that due to importance of the background checks on the national security grounds, they can not adjucate the the application , basically saying that courts don't have the authority to a) force USCIS's hand b) grant citizenship to the applicant. The judge basically instructed USCIS to do what can be done to expedite the checks and complete the process. No time lines. That is basically way I read the opinion and understood it. Certainly I am not a legal expert so if someone wants to look it up, the case was dismissed on 2/2/2007 in NJ district. Edwin Rubin was the lawyer handling the case. The opinion is available in the pacer system.

I think US Attorneys will start filing the dismissal motions for all pending and future cases as soon as they can. No judge wants to be the guy who granted citizenship to someone without necessary background checks complete (whatever the issues may be with the security checks process).

An “ADIT” Stamp is added to a passport or an Arrival-Departure Record (I-94) as temporary proof of residence. To alleviate inconvenience to our customers, USCIS continues to aggressively pursue technological improvements to allow the prompt issuing of permanent alien resident cards without the need to issue these temporary stamps.

140 LUD change after approval - 485 pending

I wonder whether anybody got a LUD on my approved 140.
My 140(NIW) was approved last August and LUD was remained
the date USCIS sent approval notice.
However, on 2/19/07 I had a new LUD on my 140 while 485 LUD
remained unchanged. In addition it was a holiday. :eek:

I have a pending H-1B extension application (I-129) and waiting for
the decision. I found that the processing time just passed my 129 receipt date. So, I thought adjudication of 129 somehow trigger the LUD change
on my 140. Please let me know if you heard similar cases.
I hope this will be the good sign on my 485 adjudication.:p
 
This sounds like they've requested the court to take jurisdiction per 1447(b) and adjudicate the pending naturalization case, and the court refused to do so. In any case, what's not good is that court did not give timelines for USCIS, even after 3 years of wait... I just wonder if that person was suing FBI or just USCIS? It's useless to sue USCIS as they cannot legally adjudicate a case while namecheck is pending, but FBI can still be sued over the unreasonable delay...

Here is the content of a the mail we received for the service request initiated 10 days ago for my spouse. Anyone has received similar mail, and what how long does this "additional review" take? Appreciate if your reply

However, we have to perform additional review on this case and this has caused longer processing time. If you do not receive a decision or notice of action from us within 6 months of this letter, please call the customer service at the # provided below"

How do you know they have ordered name check?

You have mentioned that name check has been initiated in your case and that it is pending. How did you come to come to know and when that the center has initiated name check? In my case the status has not changed since July 27( RD of my 485), though after FP there were couple of LUDs. Last LUD 1/3. Very frustating:mad:
 
Take an infopass and ask them. The reps have the information.
