Hi, there,

I am facing a dilemma here and need your suggestion.

(1) I finished my Ph.D here, and currently doing my postdoc.
(2) I have a B.Pharm and cleared FPGEC.

A chain pharmacy will sponsor my H1 and future GC as a pharmacist, but pharmacist will be in EB3, and it is the worst now (retrogression and long process, some attorney said it will take 7 years and risky). Could u plz give some suggestion which one I should stay: posydoc---low pay, no future job, but GC faster (through NIW) or pharmacist---good pay, current job, but long and risky GC process?

Any input will be highlly appreciated.

Hi rohit,

a couple of questions will help analyze your situation:
1) Are you Indian, Chinese or any other retrogressed country national?
2) Answering 1) has bearing on the claim '7 years'
3) What type of visa are you on now? How long is it good for?
4) If you have H-1B and happen to be in a retrogressed/unavailable category (like EB-3 is right now) you can still file I-140 after LC is approved and then extend H-1B in 3 year increments until visa numbers become available once again.
5) It depends what you want most. NIW might be more cumbersome because you have to prove all kinds of things (I have no experience with NIW so I cannot comment on that).
6) Try to see if you can file in EB-2 with business necessity. You degree certainly justifies that.

Thank you very much for your comments.

1) I am from India
2) A lawyer told me it probably takes 7 years to get GC through EB3
3) The comapy lawyer told me pharmacist must be in EB3 since they tried EB2 before and almost all denied
4) my new H1 will be effective on Oct 1 2005, and currently I am on my OPT.

If I decide not to go to pharmacist, and i am worrying whether the company will give me trouble since they paid money to get me this H1B. If they won't cancell my H1B, my OPT will be automatically terminated on Oct 1 2005, and I will be out of status, that will be a real trouble. Any comments and suggestion?

Per definition Pharmacist come under EB2 category:
In 2002, 85 colleges of pharmacy were accredited to confer degrees by the American Council on Pharmaceutical Education. Pharmacy programs grant the degree of Doctor of Pharmacy (Pharm.D.), which requires at least 6 years of postsecondary study and the passing of the licensure examination of a State board of pharmacy. Courses offered at colleges of pharmacy are designed to teach students how to dispense prescriptions and communicate with patients and other health care providers about drug information and patient care.

Have your credential evaluated to an US pharmacist equvalent (Doctor of Pharmacy) and apply PERM through EB2 category.

EB2 or EB3

Thanks for your information. The company lawyer said the job minimum requirement is BS in Pharmacy or PharmD. And USCIS requests pharmacist must be EB3. I am not sure whether it is true or wrong. Please advise.

If your company permits, try another reputed attorney who is confident enought to file your case in EB-2. Though there is speculation that EB-2 will retrogress soon!

Looks it is impossible to file under EB2 based on the company lawyer. Should I go to this job or just stay in Postdoc?

Make money

I would say make money...join the company....get experience....this retrogression might vanish...in a few years..you will make money get experience...and if you become post doc...there is a possibility of getting GC through waiver but you will waste time...I know I did MS...

Later when you find better company you can move into that company and submit new GC....even if you file labor in EB3...you can file 140...that is important..then you lock your priority date...at that time you can go do your postdoc if you want and join any other company later if you want and still use that priority date ....you should have a copy of approved 140 though...

It makes a lot of sense to apply GC right now than not apply at all and make money and get experience...Lot of people are still comming into states and applying GC why should you wait?
