Conditional Green Card & travel

hello all, need a question answered please. I am active duty military married to a conditional resident who expires April 2011. I have orders to an overseas assignment until jan 2013, leaving this Jan 2010. I know I will be able to do the application for permanent residence form overseas, & possibly receive extensions, or interview waivers, however my question is whether or not I need to seek USCIS permission for her to travel. I dont believe I do since this is official government duty. We are going to italy & i have to get an italian visa for her, which requires annual renewal b/c she is not american. Other than that I believe she is good up to when we apply. Any advice would be great thanks.

Well, she doesn't have any restriction on traveling outside of US. However, in order to get back into the US, she needs the GC or an extension. She will need to file I-751 before her conditional GC expires and then she can have her GC extended for 1 year (passport stamp). However, she needs to be able to make it to the fingerprinting appt, as well as the interview if needed.

Your wife may be eligible to immediate citizenship under 319(b). Take a look at this avenue.

The USCIS has an office dedicated to solving immigration issues of US military families. Please take advantage of this as you - and she - have earned the additional TLC through your service.
