I have been married to an American Citizen . She is 33 while I am 26 . Its been a month since we got married . We have been living together . She got kids but they do not live with us . I have gone through this thread and found out it is likely I get a conditional Green card . However , Is there anyway beside waiting 2 years time, I can get a permanent one ? I am going to apply in June and it will be 5 months after our marriage . I am a f-1 student graduating this december . My visa will expire in May although I will be in status .

A conditional green card is issued for ppl who are married less than two years. If you want to get a permanent green card, you should apply after 2 years getting married, since your F1 visa is going to expire in May, how do you think you can apply after 2 years being married, you will be out of the status after your f1 expires.

Most if not all f-1 students get D/S on i-94 therefore they remain in status even when their visa expires.

There is no way around the conditional green card if your card is approved before the 2 year anniversary of your marriage. You can stay on f1 until you graduate in December then try for OPT and after 12 months you can file for your green card. Otherwise if you file in June you most likely get a conditional card unless you get stuck in name check or incessant RFE's.

as long as they maintain their F-1 status by going to school full-time. If not, they fall out of status.

I dont think is there difference between both types except you have to remove conditions. Why you do not want conditional one?

I know a person who got his marriage certificate and dropped out of college. Applied for green card after like 6 months and got his green card after like 8 months.

A conditional Green card is no different than a Permanent one with the only exception that you need to remember to file for the removal of conditions after 21 months in order not to loose your priviledge. It is best not to fall out of status, so I suggest you go for the conditional card.

Thank you all for your comments . I will go ahead and apply for the green card during the first week of May . Does this matter that My wife does not have any income and I am handling the family by working in a Gas station in cash . But , after getting a conditional green card , do we have to go for a second inteview or not for removing the conditional .

First at all, if you are applying for a green card in base of your marriage with an american citizen's wife, your american citizen has to support you, if she is not working, you will need to find another person who sponsor you in addition to your wife, it can be her parents.

In reference to your second question, most of the cases get approval without a second interviwe but you never know, you can be selected to go for a second interview. Good Luck!!!!

You need to prove that your combined income is 25% above the Federal poverty line for your household size. That means getting W-2's, tax transcripts, paystubs, etc. Or get a co-sponsor with that income.

Maybe yes, maybe no. You have to apply to remove the conditions, but it doesn't always involve an interview.
