Conditional GC Expired

Hi,
I received a conditional GC (through my wife who is a US citizen) in March 08, and thus it expired March 2010. Unfortunately I was careless and only realized this today. What do you think would be the best course of action for me to take in order to get reinstated. I'm still married to the same person and have kids from the marriage as well. Like I said, I was just careless and completely forgot about it.

Hurry up and file the I-751 ASAP and hope they will accept it even thought it's late. Include the children's birth certificates with the application.
 
Thanks. I spoke to an attorney about this. He said that it shouldn't be a big problem since I'm still married and living with my wife. Hope he's right.

Just wanted to update on whats been going on with my case. I filed the I-751 in June 2010, 3 months after my conditional GC had expired and received the 1-year extension letter almost immediately. A couple weeks ago (Feb 2011), I received an interview notification. But two days before my scheduled interview, my attorney called me to say that he'd received a call from USCIS canceling my interview due to 'glitch' in my background check and that they would reschedule it to a future date.
I just found this to be a little unusual and was wondering if anyone else has had such an experience, where the interview gets canceled and rescheduled. My marriage is fully legit; we've been married almost five years and have two kids with a third on its way.

Did you get fingerprinted? How many times? Have you got a common name? Have you got any arrests in your background? Do you have any old immigration violations? Did you ever try to immigrate before getting your greencard through your wife?

Yes, at least 3 times since I first applied for the GC.

Have you got a common name?
Yes, very common Muslim first and last names. My background is Indian.

Have you got any arrests in your background?
No.

Do you have any old immigration violations?
I had let my conditional GC expire, as I'd mentioned above, but no other immigration violations.

Did you ever try to immigrate before getting your greencard through your wife?

No.


My attorney advised me to wait and see what happens. He's hopeful that its nothing to worry about and just some glitch in their computer. I have another couple months until my 1-year extension expires and hopefully this gets resolved before then.
 
"Glitches" in the immigration process have a tendency to sometimes end up in a never-ending wait. You are eligible to apply for citizenship now with the 3-year marriage rule. Your citizenship application will create more urgency for them to take action on your I-751.
