Hi,
I'm in the US on current TN status (through CBP PoE), that is valid until July. A startup (employer B) has agreed to hire me as a concurrent TN and do it through COS PP. We are putting in March 2026-2027 as the dates. They want to start with 5 hours/week but acknowledge it could increase in the coming months. If possible through employer A, I would also like to renew my TN with them before it expires (funding dependent). My questions are:
(1) In Form i-129, Part 2.2 I selected (d): concurrent employment...but for Part 2.4 do you select "E" or "F" in my scenario? F implies changing from different nonimmigrant status (not true since I already have TN), but E may be implying extending current job? I'm leaning E: extension of status.
(2) Form i-129 also has a box for wages and hours (if not full-time). How do I navigate this? I'm trying to ensure compliance, but give myself flexibility if the hours go up, without having to re-file the petition. Do I just put "10" and then in the support letter say "variable as needed between 5-15" or something to that effect? If I put 10 but then work 5 weekly for a while, will that be a problem or a violation of terms?
(3) Will the multi-job scenario I painted cause problems when I try and renew my employer A TN this July (if I get the chance)? I'm worried about the mechanics of I-94s (multiple or just one) caused by the second job, and whether CBP will have to acknowledge both in the system, etc.? How exactly does that work? Especially since one is through USCIS I-129, and one at the border, and the timelines don't line up?
