Hi MMUBEAN,Do you guys know of anyone else in the file who has been approved. I think umass has been approved though I am not sure.
Thanks for the update Umass. I must have been mistaken. I am sure you are hoping I was not. I have the same stories about the POJ calls. I have actually been lucky to have real polite IOs who though pulling the "possibly by" dates (out from who knows where) tried to be as informative as they possibly could be.Hi MMUBEAN,
Unfortunately, I've not been approved yet. There has been no activity on my application at all -- LUD is still 3/28/2007. Everything in my signature below is correct, and up to date. I will definitely let the group know if I see any changes.
I've tried calling NSC several times over the past few weeks, and I've been told that they are going through a large backlog. Initially, I was told to wait till April end and then call back if I don't see any changes by then ... then I was told to wait till mid-May ... then May end ... and now mid-June as of last week! I think that NSC is just buying time and hoping that with some cases approved by then, it will be at least that many less people for them to deal with, after June end .... I don't think that April 30, 2008 has any importance, but I hope NSC proves me wrong. While they would not entertain my calls at all earlier, at least the lady whom I talked to last week was nice enough to tell me that my case hasn't even been assigned to an officer yet, but I have cleared the FP and the IBIS checks. She said "everything is in order, so just be patient. Is there a reason why you need this in a hurry?" and my mouth just dropped ..... I said well, it way outside the current processing times and visa numbers are available (isn't that a good enough reason?) .... so she repeated "just be patient, it will happen."
So that's the latest update from my side. I check this forum everyday, but have just not posted anything recently because I have no new updates from my side. Good luck to everyone else who is waiting, and congrats to Still !!!

Umass,Hi MMUBEAN,
Even though our cases are pending at different service centers, our I-485 ND, RD and FP dates are pretty close. Were you able to get any better info from the IOs in terms of tentatively when they expect your case to be reviewed? .... or did they mention any specific deadline set by the USCIS by which IOs are expected to at least review all backlogged I-485 cases? Just curious. Thanks.
I noticed that too about the PD and the I-485 RD ..... everyone with I-485 RD around our time have their PD around 2004 time frame .... by the way, what was that link that you posted in your previous message? I'm sorry but it's not working.Umass,
Got nothing more than the April 30th ,May 2nd week, May 1st. I did not get one to tell me June yet. Maybe I was lucky or maybe there is some truth to it. There is always hoping for the best right.
I did see our 485s are close but then lots of 485s have gone past us. Not sure what to make of it. Seems like whatever they are following they are succeeding in confusing the heck out of us. Every day is like a lottery. Just have to wait and see if your "number" (or maybe the 'physical file') comes up.;-)
This should be really exciting news for us.... but then !!!

The only hope it gives me is "it could be me next"
You can correct me if you think I am wrong and maybe I am reading too much into it.. .from trackitt and here on immigration.com seems like they are working on PD's between 2000 - 2004. Coincidently all their Rds are between 2/2007 and 7/2007
Hi MMUBEEN,Umass what country are you cross charged with
Does anyone know if the IOs at Ports of Entry (airports) have an access to our pending I-485 records?
My wife is currently out of country, and returning in the next few days on Advance Parole. As such, I was wondering if I could request her to bug the IO a little bit to find out what's going on with our pending I-485 cases. Is it even possible, and has anyone does that before? I just had a thought along those lines that made me wonder. Thanks in advance to whoever that might be able to shed some light.
Hi Doji:UMass, when I used AP to enter the US this February from New York JFK airport, I was taken to a separate room. The officer stamped my passport and said 'welcome back' without asking any questions. Am not sure if they have access to any other information other than if you have ever been out of status in the country, as a basis for rejecting the parolee from re-entering. The other officer was pretty rude and rejected 2 other applicants before me.
When my wife re-entered the US 2 weeks later using her AP, the officers asked her a few questions including a ridiculous one 'is that baby your daughter? what proof do you have?' , even though he was fully aware the baby was a US Citizen. My wife felt the officer overstepped his jurisdiction, but I guess 'might is right' so my wife just bit her tongue and showed the birth certificate.
Hi Doji:
Thanks for your response. Last time when we both entered the country (around July/august last year) on AP, it was a breeze. They did not make any issues out of it at all and we walked through just like we were permanent residents, except that we had to go in a separate line in Immigration, meant only for people returning on AP. I think they call it the "Special Processing" counter.
Even my wife is returning back with our 4-month old daughter (born US citizen) and I hope they don't make her go through all this bother. The last thing you want after a tiring journey all by yourself, together with a baby with no other help, is the pain of having to go through this series of interrogations.
I was just wondering if I could ask her to treat it like an InfoPass appointment and ask the IO on the status of our pending 485s. But on second thoughts, the IO will not give her any updates on my case status due to privacy concerns (they refuse to tell me her case status on the phone too!) and as far as her status check goes, I think she will get a standard response "CIS is still awaiting the decision of the primary applicant in this I-485 application". Duh !
Hi Yabadaba:umass: its a different agency. The people at the POE are not USCIS IOs. They are CBP agents ....google cbp to get a better idea. I doubt they even have access to the data that IOs have.
You will see from my sig that though your PD is about 1.5 years earlier my RD is earlier than yours. I would say looking at your process so far you should feel lucky to see so many LUDs on your case. I have had none since Nov 2007 and that was due to a RFE I responded to.It’s been more than a month since I have submitted the response to my RFE but haven’t heard anything yet.
What should I do? I just don’t want to sit and wait for some IO’s mercy. Is there anything I can do to help my case?
Please advice.

I know exactly how you are feeling. I am sure there are many here who would say exactly that. Each of our cases has a little bit of a twist to it from the others may it be "need to change employers" or something else. We try to find some way of making a positive impact. APs, EADs can go only so far in some of our cases. In general we could be told you have a EAD or AP so whats the problem. When its not always that easy. Just wanted to stress I and many others here are in the same plight. Hope you get it soon.
Apart from WOM I cannot think of anything else. Even that and I have considered it, according to my lawyer, can only be applicable if your I485 has been in process for more than a couple of years.Let me know if you hear differently.
Umass,Hi MMUBEEN:
I agree. If you notice, my RD is about a month before yours, though your PD is about 3.5 years ahead of mine. Your RFE on 11/7/07 indicates that your case was at least looked at once. In my case, the RD is 2/8/07 and the LUD is 3/28/07 when I had my fingerprinting done. Nothing since.
I think it's a case where a blacksmith thinks the tinsmith is better, while the tinsmith thinks a goldsmith is better and so on. I agree with you that a lot of our career advancements are dependent on these applications. It's a shame that now POJ method also isn't working much, because quite simply they refuse to even look at your case and ask you to call back after April end/mid-May/May end/Mid-June .....
Yeah, and by the time all those cases get approved and its time for our cases, the visa numbers will no longer be available. So we'll be left with no option but to wait till October .... and I'm hearing rumors that EB2 ROW category might also start retrogressing now .... sweet mercy !Umass,
The trend seems to have shifted to the newly opened up 2000 - 2002 EB2 India category and some current ROW I485s. Towards the end of March a number of cross chargeability cases had got approved and I was feeling warm. But feel left out in the cold again.
