Concurrent Filing - Using Cross Chargeability

Very interesting doji. I have already called NSC a couple of times and spoken to an IO. I have asked them if our cases have been filed under CC. Every time I get the same response that they do not have that information. I have been recommended twice to get an Infopass apptmt to check if our cases have been filed under CC. I dont see how an IO at an office will have any different information than what an IO has over at the processing centers. i have scheduled an Infopass for next week, but am contemplating if its gonna do any good.
My spouse called last year to be told that her name check has been cleared So my background check is the only thing thats pending. Oh well...

In my case Infopass was TOTALLY wastage of time plus I got a parking ticket because all parking lots around LA downtown were full and was forced to park on the street. This lady officer had no clue about CC at Infopass.

I would advice to call them using POJ at least twice every week until they tell you that case has been assigned to an officer. I guess in my case this helped me.

If the Immigration Watch website (www.immigrationwatch.com) is to be believed, it appears that USCIS is working even on weekends to process all applications.

I've seen people mentioning on trackitt that they've received LUDs on weekends, but for some reason, I really find this hard to believe.
 
Does anyone know if InfoPass is helpful or not? What kind of information can we get and can we request to check if CC is considered or not?
 
I got an update on my spouses case today. They have sent an RFE today. Has anyone tried POJ to get information on what the RFE may be about? I believe RFEs are sent to the lawyer correct?

I have had mixed luck with Infopass. For the most part they tell you the same information that you can obtain over the phone. If the INS office is too far away for you to go to, I recommend calling service centers to get more information on your case. If you'd have to speak to a live person, then go via Infopass. Either way the information should be the identical
 
So,

I called NSC to check on the status of my case again .... I wanted to know whether my case has been assigned to an officer ... and I was told to wait till Mid-May and then call back, if I don't hear anything from NSC till then .... I was asked when I filed my I-485 and when I said Feb '07 I was told "oh this is still too early for you sir. There are applications that have been waiting for years. You're only waiting for 13 months, so I would say wait till mid-May at least before you call us back because..." and then I was told about the whole FBI NC Memo ..... then the customer rep repeated again that my case was relatively very new for me to be too concerned at this point.

This is so frustrating ..... how on earth is Feb '07 early when NSC is currently processing employment based I-485 applications received July 30, 2007 ? When I had called 2 weeks ago, I was told to wait till April 30th and then call CIS if I don't hear anything by then .... before that, I had called in the last week of February and I was told to wait till March 10th and then call back ....

I've started to loose faith in these dates now ... I think they mean nothing in terms of absolute deadlines .... it appears that CIS is simply buying time and fending off people calling customer service, by offering these suggestions to wait for a while and then call back .... very disappointing, if true !

I just received a soft LUD on my case but haven’t seen any LUD on my wife’s case.

I have a question for guys who got approved with CC.

Did you guys see any LUD on you spouse’s case JUST before getting the approval?

RFE --ON I485--please help.

Got an RfE on I485 it asked for the copies of all I 94 are required--the problem is , I do not have the first and the second one. I was a student at that time and in 1999 they used to use the same I94 number so i have the number. I also have the I120 form issued to the students and can show that was never out of status.

My question is if i submit the I94 i have and not all of them as asked in the RFE will they reject my application?and will loose all my hope and dreams...

plz advice i am in living hell right now..:(

Hi Plztoday,
Consult with your lawyer for the best plan of action. Best bet would be to submit all the I94s that you have copies of and write up an explanation for the ones that you do not have. You can submit the I120 to prove that you were never out of status (if thats what they are looking for). It is indeed hard to decipher, why they need all the I94s. Provide them with copies of what you have.

We are all clear at last

Hi All,

Yesterday the much awaited email for welcome notice for my wife came. So we are all clear at last.

Came to the US for the first time in Sept'01 on L1. Went back in just over 2 months. Came back in Jan 02. Moved to the South in Feb.'05. In Oct. I was converted to H1 on the suggestion of my attorney.

Though my PD is 10/2005, my GC journey started sometime around May05, when my co decided to sponsor my GC as I was preparing to go back to India.
Around July'05 I met our co-provided attorney, who told me about CC when she heard about my wife's COB.

After all the ads and pre-work etc. My labor got filed in Oct.'05.
During Labor I had an Audit, and I thought end-of-story. Some how my attorney managed to come out of it and my LC got approved in Jan-end 06.

My efficient HR-Manager took a very short time of almost 3 months to prepare the papers for my I140 which ultimately got filed in Mid-April 06.
I140 stage was the coolest of the 3 stages for me, as it got approved in 35 days in May06.

Again my HR-Manager and Attorney took a very short time of 2 months to prepare the papers for our I485 and it got filed in July'06.
Got an RFE to prove my legal status for my 485 as because my attorney forgot to send 1-2 H1/L1 approval extension notice.
Called using POJ a couple of times and each time got to know that my NC is pending. Then wrote letters to both senators, without waiting wrote to FL as well. There was no resp. from 1 senator while another was very helpful and followed up with USCIS, also wrote back saying that my NC is now clear. FL's office also wrote similar reply saying when my NC was sent back.
Ironically in Sept'07 when my NC was pending I/Os said over phone(using POJ) that everything was clear for my wife, just awiting Primary's approval.
After my NC got cleared, the I/Os started saying that my wife's BC conducted by USCIS is pending.
Never went for an Infopass. Cannot spend time outside client office so put the phone to full use.

Money wise spent approx 8K+ on attorney fees. Even though it says co sponsored, it is us who have to provide the attorney fees.

Now to put some realism to my hope I kept in touch with the latest "pulse" of USCIS and other involved orgs. by regularly visiting these forums and also sharing what I knew, what I heard. etc. So if I heard that currently there are no approvals and USCIS is replying back everybody saying that waith 6 months, I started hoping 6-months. If I saw a lot of approvals after 2 months I started expecting something in 2 months. So my friends dont loose hope just try to keep up with the "pulse" of USCIS.

I also think writing to FL/Senators help.

I will be visiting this forum, whenever I get time off from my 2-month old daughter.

I used to maintain the tracker. You can become the tracker keeper of the thread. My personal suggestion: it would be nice if only 1 person keeps updating the sheet and reposting it as this avaids version problems.

It's always wonderful to hear from people that the journey is finally over. But more revealing is the many paths and trails people have to navigate to arrive at their destination. Each person's story is absolutely fascinating, and so was yours.
