Concurrent Filing - Using Cross Chargeability

Form for CC

Hi all,

Is there a form for CC that is available via TSC? I am not talking about the cover letter form that is on Rajiv's website.

My lawyer mentioned that TSC is sending him a form to request CC.

not sure if i m getting jerked around or what.

This is the only form I know which was earlier posted on this thread by one of the guys who is approved already.

I just received an e-mail from the USCIS about issuing the RFE for my case.

it would be my guess but it could be either about my Birth certificate or TB Skin test.

If it about TB skin test then I am not worried I will do it again. I had documented +ve skin test history do didn’t do the skin test. But I guess I should have done it anyway.

But I believe it should be about my birth certificate. I have a birth certificate that is late registered at the birth register office (in 2003).
Since I had an idea, i have already asked for affidavits in support of my late registered birth certificate. I have received one affidavit from my mom and dad each and one from my uncle.

I have school/college certificate that has my name and date of birth and my father name.

What other documents should I try to get for my birth certificate? I am really nervous and worried.

Please tell me that it will be fine. I really am worried.

My birth certificate was also registered in 2002. I think you should be fine with your affidavits.

VS..you should be fine with the affidavits. Wait to see what the RFE says..dont worry about it now. At least someone is looking into your case. My guess is something green on the horizon :)

I wish your prediction was true, but I see cases pending approval for the past 24-30 months, so I'm sure there are quite a few people ahead of me in the queue .... but, here's an interesting memo from USCIS that I found .... it was released yesterday, and if true, we all could be cleared by mid-March:

I dont think this memo will have any effect on my case. My name check was cleared long back. Its just the processing time for me. Actually with the namecheck backlog clearing, I thing the processing dates will move back. It may be quite some time before I see the end of the tunnel.

Your RD is before the published processing date. Why dont you open a SR?

I did. I had initiated a SR in November 2007, because that's when the processing date went 30 days past my RD ..... and I just got an e-mail from CIS last week saying the following:

"Recently, you called us regarding your I-485, Application to Register Permanent Residence or to Adjust Status. Service records show your case is currently waiting to be reviewed by an officer. You will receive a decision or notice of other action once your case is adjudicated. This service request will be routed to your file and the officer will review your request for Cross-chargability due to your wife's country of birth being xxxx.

USCIS will be starting to adjudicate I-485 applications where the FBI name check has been pending 180 days. If otherwise approvable these cases may be worked. Because of the volume of these cases there is no way to predict when your case will be adjudicated. Expedites will not be accepted on this work load."

So, I'm not sure what to make of it, if anything at all. All I know is when I talked to the national center to open a SR, I repeated myself like 5 times to make sure that my case gets considered for Cross-Chargeability. From this CIS e-mail, it looks like that's taken care of. But I don't know what "your case is currently waiting to be reviewed by an officer" exactly means in terms of how much longer it will take.

This is actually very good news and I also confirmed this with my attorneys. They have tried to inquire about the impact that this may have but USCIS has provided the wait and see answer. They expect to start seeing approvals very soon. Mid-March is not very far away folks....lets wait and see what happens

Umass - wow atleast you got a specific response. i enquired around the same time because i had also just gone out of the 30 day processing window. the response I received was more of a canned response along the lines of "we need additional time to process your case and you should expect to hear a decision from us within 6 months". It did not state that I was stuck in name check so not sure if this new rule will help me

oh well, just wait and see i guess

We had both initiated SR one the same day in November last year, but she got her an e-mail from CIS in the last week of January, just days before the 2/4/08 memo was released. Whereas in my case, I got this e-mail just last week. So, maybe that has something to do with it, since you received the generic response (assuming you received it before 2/4/08).

Umass - Interesting...Yes mine was before 2/8. Well the memo clealry states that applications should be cleared by mid-march. Only time will tell now
 
did not get any RFE; and had not submitted any affidavits; the birth certificate that I had submitted, worked. I had requested my parents to prepare affidavits, in case I needed them.
