Concurrent filing or no

How long does it take for the INS to approve the petition I-130? I know that we can file concurrent filing with I-485; however, we are still in the process of gathering joint documents. What would be best to do this?

According to the USCIS website it taking a average of 5 months to process an I-130 alone. However, if it is an immediate relative then the I-485 can be filed at any time even if the I-130 has not been approved yet. If you do file the I-485 while the I-130 is processing, then include a copy of the I-130 receipt with the I-485 application.

So are you suggesting we wait until we get all the docs then concurrent file I-130 and 485 together? That way they will be in one package and possibly speed things up a little bit?

My honest recommendation is to wait till you are ready to file the I-485. I filed concurrently for my wife and the I-130 was approved at the time of the interview. Even if you send in the I-130 and then send in the I-485 later, your I-485 will still take the same amount of time to be processed (according to the USCIS website the processing goal for I-485 is 4 months). Also, the I-130 could be in one location and the I-485 in another and it might add time to have the two forms placed in the same file.

To better explain it, lets say you submit your I-130 today (March 19th) and then submit the I-485 on May 1st. The I-485 will be processed with May 1st applications, and they won't speed it up because there was a I-130 submitted a month and a half earlier.

Thank you. Then how come this "concourrent" filing option is available?

Don't know. All I know is it is allowed and this is how most people do it for immediate relatives since a visa number is automatically available.

Oh I just re-read it... so I-130 and I-485 don't go into the same package? it has to be separate even when you file them together? I misunderstood the term concurrent I think. ...

Yeah, we sent the I-130 and the I-485, and all necessary documentation and forms, in the same envelope to the Chicago Lockbox. We used one binder clip per form to clip the form and the evidence for the form together. We also included one check in the amount of $1365 payable to US Department of Homeland Security to cover both the I-130 and I-485 fee. (Sending one check is optional and most people send two, one for each form.) We also sent G-1145 to receive an email on when the applications where accepted by the lockbox. The emails came a week after mailing the package, and the official receipt notices came in the mail five days after the emails.

Sorry, I though you where questioning the law.
