Completing 2 yrs HRR in Sept 2005,Filing for H1B

Hi Lucymo,

I will be completing the 2 yrs HRR on coming sep 2005. I have not visited to any other country since returning from USA on Sep 2003.

Can I go ahead and apply for H1B petition for October 2005 quota ? Or is it I have to wait till Sep 2005 to apply for H1B.

Please share your thoughts.

So you would say that even though I will be completing my 2 yrs HRR in Sep 2005,I can still go ahead and file for my H1B Petition by End of July 2005.

Will INS put a query while approving the H1B for 2 yrs HRR, if they try to process within sept 2005. If at all they do approve then it would imply that I can get Stamping of H1b only after Sep 2005.

Meanwhile what documens would consulate require to prove for me to show that I have completed the 2 yrs rule.

passport stamps, bills, leases, work or school records, anything that shows you were in fact in your country for two years total.
 
J-1 to H-1

Hi,

I am an Indian citizen. I completed MS in may 2005. My MS degree is from a Thailand university (In academic partnership with three US Universities). Currently I am on a J-1 Research Scholar visa (which will expire on 31 march 2007) at a US university. I am now in a process of getting 2 year HRR waiver which i suppose to get it by the end of 2005.
I have the following questions regarding the H1-B visa:

1) Can I change my status to H1B? If Yes, then What will be the best time to apply for H1B and Can i do that while staying in US?
2) Do I come under the category of MS graduates from US universities as my degree is from Thailand university but it has academic partnership with three US universities.
