Company withdraw I-140....Any idea???

Hi everyone,

My company informed me that they withdraw my I140 two days ago. Does anyone know how long will take USIC to process withdraw case? I am so disappointed about it because I think two more months my I140 may get approval. I have been spent 4 years in this company, and all suddendly, all my time and effort are in vain.
My I140 RD: Aug 30. 2003
I485 Rd: Jan 4, 2004
EAD, AP: approval March,2004
FP done: April, 2004

The company laid me off in May. Please let me know if I still can hold any hope on this I140? Any chance get approval on this I140? Is there anyway that I can keep this I140 processing or I need to start over again from LC???
Any advice will be highly appreciated.

hi there, sorry to hear what you company is doing to you.....
I share your sadness...my sugestion will be that you try to talk your company not to withdraw the I 140, if they have already done so, then try to get a new sponsor, i mean an offer of employment, in same category as labor certification, and sent it asap to ins and try to invoke the ac 21 law, some people here in this forum say that you must have an appoved i-140 before you can change employer, but hey.......what have you got to loose?????????

in your letter to ins tell them how long you have been trying to obtain pr, and ask for their help in a humble way.....like i said before it may not work....but i have seen here in this forum someone who changed employer without having i-140 approved, call or fax ins and maybe you'll get lucky and they can approve it before the withdraw letter gets processed by them

Thank you for your information.
The company have sent the withdrawn letter to INS last week, so i don't think they will help me out with my GC process.
I will try to do AC21 and send the letter to INS. I will try it and keep a hope until the last minute ( i mean until i got deny)

--- That is correct, even if they sent letter to USCIS to withdraw the I-140, request them not to withdraw, they can again send the letter NOT to withdraw.

------- Poster I-140 is Withdrawn and he will have no pending I-140, I-40 can only be Revoked if it has been approved. He will have no base of AC21 becase his I-140 has been Withdrawn by employer,
Do you think USCIS will listen to the letter that XYZ has been working for 4-7 years for I-140 or I-485? No they go by published rules by INS H.Q

------- I am sorry to say, the poster does not stand ANY chance for AC21 or for GC from this employer becase poster has no Approved I-140 and no I-485 pending more than 180 days, he is NOT eligible for AC21, let him start GC process from new LC or request the employer NOT to withdraw the I-140
